A California congresswoman says the federal law used to prosecute Internet activist Aaron Swartz should be changed to "prevent what happened to Aaron from happening to other Internet users."

Zoe Lofgren, a Democrat whose district includes Silicon Valley, floated her proposal?for what is being called "Aaron's Law" on Reddit. "There's?no way to reverse the tragedy of Aaron?s death, but we can work to prevent a repeat of the abuses of power he experienced,"?she?wrote.

Swartz,?26,?who helped create RSS as a teen, reportedly took his own?life last Friday.?His family and partner said in a statement that his death is "not simply a personal tragedy. It is the product of a criminal justice system rife with intimidation and prosecutorial overreach."

A passionate advocate for making as much information public as possible on the Web, Swartz was under indictment by the federal government on charges of wire fraud and computer fraud.?In an attempt to provide free access to JSTOR, a subscription service for science and literacy journals on MIT's network, he downloaded nearly the entire library of 4.8 million articles and documents to make it publicly available.

The ?government was prosecuting Swartz based on violations of?the Computer Fraud and Abuse Act.?

"It looks like the government used the vague wording of those laws to claim that violating an online service?s user agreement or terms of service is a violation of the CFAA and the wire fraud statute," Lofgren said on Reddit. "Using the law in this way could criminalize many everyday activities and allow for outlandishly severe penalties."

Lofgren said a "simple way to correct this dangerous legal interpretation is to change the CFAA and the wire fraud statutes to exclude terms-of-service violations." She said she plans to introduce a bill, known as "Aaron's Law," that will do that, and will try to get both Democrats and Republicans to co-sponsor the bill.

Marcia Hofmann,?a senior staff attorney with?the Electronic Frontier Foundation, said in a blog post that the government "should never have thrown the book at Aaron for accessing MIT's network and downloading scholarly research. However, some extremely problematic elements of the law made it possible."

She?also?wrote?that?violations?of?the?law?are?"harsh and disproportionate to the magnitude of offenses. Even first-time offenses for accessing a protected computer 'without authorization'?can be punishable by up to five years in prison each (10 years for repeat offenses) plus fines. It's worth noting that five years is a relatively light maximum penalty by CFAA standards; violations of other parts of that law are punishable by up to 10 years, 20 years, and even life in prison."

Lawrence?Lessig,?professor?of?law?and?leadership?at?Harvard?Law?School,?wrote?Wednesday?in?The?Atlantic?that?it?was?appropriate?Lofgren?first?introduced?her?draft?bill?on?Reddit,?"a platform Aaron had helped to build."

The?bill,?he?wrote,?"would limit the scope of the Computer Fraud and Abuse Act and exclude 'crimes'?that are nothing more than a breach of contract. Had that change been made before Aaron's death, the government's felony charges would likely have collapsed. Had the government's charges collapsed, Aaron Swartz, in my view, would still be frantically working to make the world a better place."

The urgent, unfamiliar alarms blaring from Lisa Agro's iPhone and her boyfriend's Galaxy at 1:42 a.m. Monday jolted the pair out of bed.

"It sounded like a Nazi air-raid siren," Agro recalled Tuesday. "It freaked me out. I knew it wasn't a ringtone."

The Hollywood couple ? and thousands of other smartphone owners in Florida ? had suddenly become acquainted with the latest way local, state and federal authorities are spreading the word about local emergencies.

In this case, it was a missing 2-year-old in Collier County.

"An AMBER Alert has been issued in your area, please check local media," the message read.

Fortunately, the child was found safe hours later, but not before many in Florida were left scratching their heads over how they received the disquieting alert without ever signing up for it.

The free alert ? with its unique alarm and vibration ? was sent through the federal government's Commercial Mobile Alert System, which has been sending out similar alerts to smartphones for several months. A congressional act in 2006 required all wireless carriers to manufacture phones capable of receiving such alerts by April 2012. The law calls for installing software on the phone that connects to the system and emits the alarming sound.

Buy a new cellphone lately? Chances are you were automatically signed up for the alerts.

Since April, the system has been used mostly to warn citizens about imminent dangers such as tornadoes and hurricanes. It is also designed to send out emergency alerts from the president.

On Jan. 1, the National Center for Missing and Exploited Children joined the network and now? sends out the Amber Alerts to wireless phones nationwide. It was the first time such an alert was sent out in Florida, said the center's program manager, Bob Hoever.

"The purpose of the Amber Alert is to rapidly notify the public as soon as possible when a child is facing danger," he said. "In this case, the wireless emergency alerts afford us [an opportunity] to reach a much wider audience."

In Florida, the Amber Alerts will still be issued by the Florida Department of Law Enforcement through emails and social media, among other means. But now the agency also will alert the national center so they can send out the wireless messages, said agency spokeswoman Gretl Plessinger.

The messages, transmitted through local cellphone towers, can be sent to a specific location, meaning even a person visiting South Florida from another state will receive the alert.

Customers may opt out of the alerts by changing their settings or calling their service provider. Alerts from the president, however, can't be declined, according to FEMA, which administers the program.

Monday's early morning Amber Alert in Florida became a widely discussed topic through social media, with many still confused over what they had received. Some supported it; others bemoaned being awakened in a panic.

"I didn't sign up but I'm happy I got it," wrote Facebook user Manuela Guntert Barson. "If it were my kid, I would want the whole world on the lookout."

Others complained that the alert didn't go far enough. Laura Esquivel, of Hollywood, said she spent more than an hour combing the Internet for more information about the missing child.

"I couldn't sleep that night. I kept wondering about the little girl and her family," she said.

That national center, however, is limited to only 90 characters and can't include other information, such as an Internet address or a full description of the missing child, officials explained.

Officials with the center decided on a policy to keep the messages simple while directing phone owners to seek more information through the local media.

Conservatives who petition the White House empower his dictatorial inclinations and separation of powers grabs

White House now requires ?We the People? petitions to have 100,000 signatures for official response:

President Barack Obama?s deputies have quadrupled the number of signatures that petitioners on the administration?s ?We the People? website must collect to get an official response from the White?House, following a series of popular, provocative and disrespectful signature drives by his critics.

Some of the petitions sought approval for states to secede after Obama?s re-election, while others called on the White House to disavow executive orders that restrict gun rights, or to deport CNN?s British-born, progressive host Piers Morgan.

?Starting today, as we move into a second term, petitions must receive 100,000 signatures in 30 days in order to receive an official response from the Obama Administration,? said an early evening Jan. 15 statement from Macon Phillips, the White House?s digital strategy director.

We the People, and especially we the conservative people, ought to make more productive use of our time collecting signatures designed to elicit the opinion of Barack Hussein Obama. Would it matter if President Obama issued an ?official? website response agreeing that Texas or South Carolina should secede from the Union or that Piers Morgan should be deported?

Given this president?s serial violations the Rule of Law from federal court order defying oil drilling moratoriums to amnesty for young illegals, one would be tempted to suspect that Obama is a Sicilian Godfather and every day is ?the day of his daughter?s wedding?:

Conservatives should direct all this petition signature-obtaining energy to sending Speaker John Boehner a tea partier-inspired message on how best to deal with the upcoming debt ceiling and end of continuing resolution/budget/government shutdown battles in 2013 and to electing more Tim Scotts and Rand Pauls to the United States Congress in 2014; rather than indulging Obama?s ego while also providing he and the media fodder for the ridicule of conservatives as un-serious.

Yes, we cherish our First Amendment right to ?petition the Government for a redress of grievances?, but We the People, of all people, should do so with respect for the separation of powers enshrined in the document whose preamble begins by citing We the People that ratified it.

Hate crime Charity Galop has become the latest LGBT?organisation to criticise Julie Burchill?for writing a highly offensive article about the trans community in last weekend?s Observer newspaper.

In a statement the London-based charity said: ?We?ve been considering the Julie Burchill article in the Observer with an overwhelming sense of sadness and anger. Every day we work with, and get reports from, trans people who experience daily harassment and violence for nothing more than being themselves. The people who harass, hate and hurt think it?s OK to do so and articles like the ones last week help create a society that allows it to happen.?

Galop continued:??We?ve been asked by a number of people about reporting Julie Burchill, and the Observer, to the police, for hate speech. We absolutely understand the hurt and anguish that reading an article such as this causes people, however our advice is that this article is not a criminal offence. There is no legislation outlawing incitement to transphobic hatred (a situation which we abhor, and actively campaign against), and even if there was, it would mirror incitement legalisation that does exist.

?This legislation places a high threshold on an action before it counts as incitement ? and the article would have needed to reach this threshold (for example directly advocating violence). The expectation is that even grossly offensive and hurtful articles would not be outlawed in legislation.?

The statement concluded:??Instead, we?ve supported the complaints to the Press Complaints Commission and the Observer, and we?re pleased that the Observer?s editor has removed the article from the website, and look forward to a more detailed response from the Reader?s Editor.?

On Monday, Scottish Transgender Alliance (STA) warned of ?rising transphobia in the British media.?

The editor of the Observer, John Mulholland?withdrew?Burchill?s column and apologised for the upset that it caused yesterday.

NEW YORK (AP) ? "The Killing" will live another season.

AMC and Fox Television Studios announced Tuesday the return of this crime drama for a third season after months spent in limbo.

The show's stars, Mireille (MEE'ray) Enos and Joel Kinnaman, will be back, as will executive producer Veena Sud. Production resumes Feb. 25 in Vancouver, which substitutes for Seattle, the show's setting. No premiere date was mentioned.

The first two seasons concentrated on the murder case of teenager Rosie Larsen. The 12-episode third season will focus on and solve a new crime.

The show's revival, though surprising to some viewers who had given it up for dead, had been rumored for several weeks.

"The Killing" premiered on the AMC network in April 2011, and during its first two seasons averaged 1.9 million viewers.

WASHINGTON, DC, January 15, 2013 College students who aren't studying hard may have their parents' financial support to blame.

A new study by University of California, Merced, sociology professor Laura T. Hamilton found that students' GPAs decreased with increased financial support from their parents. The study also found that students with financial aid from their parents were more likely to complete college and earn a degree. The study, "More is More or More is Less? Parental Financial Investments during College," will appear in the February issue of the American Sociological Review and has been posted on the publisher's website.

"Students with parental support are best described as staying out of serious academic trouble, but dialing down their academic efforts," Hamilton wrote in the study.

Over the past several decades, colleges and universities have responded to deep cuts in external funding by increasing tuition. The costs increasingly fall on the shoulders of American parents, who often make difficult financial decisions to send their children to college. Hamilton wanted to know whether parental dollars translated to better college outcomes for children or whether they created disincentive to excel.

The answer turned out to be complex, with parental support reducing academic achievement but improving the likelihood of graduation.

"Regardless of class background, the toll parental aid takes on GPA is modest," Hamilton wrote. "Yet, any reduction in student GPA due to parental aidwhich is typically offered with the best of intentionsis both surprising and important."

College students may spend their time in ways that don't reflect their parents' wishes, Hamilton said. A different study found today's college students spend an average of 28 hours a week on classes and homework combined, less than an average high school student spends in school alone. The same study also found college students spend an average of 41 hours a week on social and recreational events.

According to Hamilton's study, parental aid increased the odds of graduating within five years. Students with no parental aid in their first year of college had a 56.4 percent predicted probability of graduating, compared with 65.2 percent for students who received $12,000 in aid from their parents.

Hamilton said students might be satisficingtrying to be adequate on multiple fronts rather than trying to excel in one particular area. This makes sense in the context of today's young adult college experience, where there are great freedoms, little oversight, and many social opportunities.

Hamilton notes that many other funding sources such as grants and scholarships, work-study, student employment, and veteran's benefits do not have negative effects on student GPA. Unlike parental aid or loans, these other funding sources may come with a sense of having been earned by the student. With decreased state and federal support for higher education, however, such funds are increasingly hard for families to access.

Hamilton cautions that her results do not mean parents should cut off financial support altogetherparticularly given the importance of parental funds for getting a degree. However, it is important for parents to set standards, such as a required GPA, and keep students accountable for their performance.

For the study, Hamilton relied on two nationally representative datasets collected by the National Center for Educational Statistics. The research was supported by a grant from the American Educational Research Association.

Prime Minister David Cameron aims to take advantage of possible EU treaty changes sparked by further integration of eurozone countries to reshape Britain's own ties with the 27-member bloc.

Clegg said there was no guarantee deeper integration would require treaty changes, or if so, when that would happen, creating uncertainty for Britain's business environment.

Physicians may soon have a new way to screen patients for Barrett's esophagus, a precancerous condition usually caused by chronic exposure to stomach acid. Researchers at the Wellman Center for Photomedicine at Massachusetts General Hospital (MGH) have developed an imaging system enclosed in a capsule about the size of a multivitamin pill that creates detailed, microscopic images of the esophageal wall. The system has several advantages over traditional endoscopy.

"This system gives us a convenient way to screen for Barrett's that doesn't require patient sedation, a specialized setting and equipment, or a physician who has been trained in endoscopy," says Gary Tearney, MD, PhD, of the Wellman Center and the MGH Pathology Department, corresponding author of the report receiving online publication in Nature Medicine. "By showing the three-dimensional, microscopic structure of the esophageal lining, it reveals much more detail than can be seen with even high-resolution endoscopy."

The system developed by Tearney and his colleagues involves a capsule containing optical frequency domain imaging (OFDI) technology ? a rapidly rotating laser tip emitting a beam of near-infrared light and sensors that record light reflected back from the esophageal lining. The capsule is attached to a string-like tether that connects to the imaging console and allows a physician or other health professional to control the system. After the capsule is swallowed by a patient, it is carried down the esophagus by normal contraction of the surrounding muscles. When the capsule reaches the entrance to the stomach, it can be pulled back up by the tether. OFDI images are taken throughout the capsule's transit down and up the esophagus.

The researchers tested the system in 13 unsedated participants ? six known to have Barrett's esophagus and seven healthy volunteers. The physicians operating the system were able to image the entire esophagus in less than a minute, and a procedure involving four passes ? two down the esophagus and two up ? could be completed in around six minutes. A typical endoscopic examination requires that the patient stay in the endoscopy unit for approximately 90 minutes. The detailed microscopic images produced by the OFDI system revealed subsurface structures not easily seen with endoscopy and clearly distinguished the cellular changes that signify Barrett's esophagus. Study participants who had previously undergone endoscopy indicated they preferred the new procedure.

"The images produced have been some of the best we have seen of the esophagus," says Tearney, a professor of Pathology at Harvard Medical School and an MGH Research Scholar. "We originally were concerned that we might miss a lot of data because of the small size of the capsule; but we were surprised to find that, once the pill has been swallowed, it is firmly 'grasped' by the esophagus, allowing complete microscopic imaging of the entire wall. Other methods we have tried can compress the esophageal lining, making it difficult to obtain accurate, three-dimensional pictures. The capsule device provides additional key diagnostic information by making it possible to see the surface structure in greater detail"

Current recommendations for diagnosis of Barrett's esophagus, which is uncommon in women, call for endoscopic screening of men with chronic, frequent heartburn and other symptoms of gastroesophageal reflux disease. Study co-author Norman Nishioka, MD, Wellman Center and MGH Gastroenterology, notes, "An inexpensive, low-risk device could be used to screen larger groups of patients, with the hope that close surveillance of patients found to have Barrett's could allow us to prevent esophageal cancer or to discover it at an earlier, potentially curable stage. But we need more studies to see if that hope would be fulfilled."
