HSBC to pay record $1.9B fine in money-laundering case

(Reuters) - HSBC Holdings Plc agreed to pay a record $1.92 billion in fines to U.S. authorities for allowing itself to be used to launder a river of drug money flowing out of Mexico and other banking lapses.

Mexico's Sinaloa cartel and Colombia's Norte del Valle cartel between them laundered $881 million through HSBC and a Mexican unit, the U.S. Justice Department said on Tuesday.

In a deferred prosecution agreement with the Justice Department, the bank acknowledged it failed to maintain an effective program against money laundering and failed to conduct basic due diligence on some of its account holders.

Under the agreement, which was reported by Reuters last week, the bank agreed to take steps to fix the problems, forfeit $1.256 billion, and retain a compliance monitor. The bank also agreed to pay $665 million in civil penalties to regulators including to the Office of the Comptroller of the Currency, the Federal Reserve, and the Treasury Department.

"We accept responsibility for our past mistakes. We have said we are profoundly sorry for them, and we do so again. The HSBC of today is a fundamentally different organization from the one that made those mistakes," HSBC Chief Executive Stuart Gulliver said.

THE PLACE TO LAUNDER MONEY

HSBC's money-laundering lapses in Mexico and elsewhere were cited in an extensive Senate report earlier this year, but the documents filed in court on Tuesday provided new details.

Despite the known risks of doing business in Mexico, the bank put the country in its lowest risk category, which excluded $670 billion in transactions from the monitoring systems, according to the documents.

Bank officials repeatedly ignored internal warnings that HSBC's monitoring systems were inadequate, the Justice Department said. In 2008, for example, the CEO of HSBC Mexico was told that Mexican law enforcement had a recording of a Mexican drug lord saying that HSBC Mexico was the place to launder money.

Mexican traffickers used boxes specifically designed to the dimensions of an HSBC Mexico teller's window to deposit cash on a daily basis.

The agreement also described a vastly understaffed compliance department. At times, only one to four employees were responsible for reviewing alerts identifying suspicious wire transactions. When HSBC processed bulk cash, a business it calls Banknotes, only one or two compliance officials oversaw transactions for 500 to 600 customers, the Justice Department said.

Compliance was "woefully inadequate," Loretta Lynch, the U.S. Attorney in Brooklyn, said at a press conference.

SANCTIONS VIOLATIONS

In documents filed in federal court in Brooklyn, the Justice Department also charged the bank with violating sanctions laws by doing business with customers in Iran, Libya, Sudan, Burma and Cuba.

HSBC separately reached a settlement with British watchdog the Financial Services Authority.

"The HSBC settlement sends a powerful wakeup call to multinational banks about the consequences of disregarding their anti-money laundering obligations," said Senator Carl Levin, who led the Senate inquiry.

U.S. and European banks have now agreed to settlements with U.S. regulators totaling some $5 billion in recent years on charges they violated U.S. sanctions and failed to police potentially illicit transactions.

No bank or bank executives have been indicted. Instead, prosecutors have used deferred prosecutions, under which criminal charges against a firm are set aside if it agrees to conditions such as paying fines and changing its behavior.

"In trying to reach a result that's fair and just and powerful, you also have to look at the collateral consequences," DOJ criminal chief Lanny Breuer said at the Brooklyn press conference.

The settlement is the third time in a decade that HSBC has been penalized for lax controls and ordered by U.S. authorities to improve its monitoring of suspicious transactions. Previous directives by regulators to improve oversight came in 2003 and in 2010.

Last month, HSBC told investors it had set aside $1.5 billion to cover fines or penalties stemming from the inquiry and warned that costs could be significantly higher.

Analyst Jim Antos of Mizuho Securities said that while the fine was huge in cash terms, the settlement costs were "trivial" in terms of the company's book value.

HSBC shares closed up 0.56 percent at 644.8 pence in London.

ANTI-MONEY LAUNDERING CONTROLS

HSBC said it had increased spending on anti-money laundering systems by around nine times between 2009 and 2011, exited business relationships and clawed back bonuses for senior executives. As evidence of its determination to change, it cited the hiring last January of Stuart Levey, a former top U.S. Treasury Department official, as chief legal officer.

Under a five-year agreement with the Justice Department, HSBC agreed to have an independent monitor evaluate its progress in improving its compliance.

It also said that as part of the overhaul of its controls, it has launched a global review of its "Know Your Customer" files, which will cost an estimated $700 million over five years. The files are designed to ensure that banks do not unwittingly act as conduits for criminal funds.

HSBC's settlement comes a day after rival British bank Standard Chartered Plc agreed to a $327 million settlement with U.S. law enforcement agencies for sanctions violations, a pact that follows a $340 million settlement the bank reached with the New York bank regulator in August.

Such settlements have become commonplace. In what had been the largest settlement until this week, ING Bank NV in June agreed to pay $619 million to settle U.S. government allegations that it violated sanctions against countries including Cuba and Iran.

In the United States, J.P. Morgan Chase & Co, Wachovia Corp and Citigroup Inc have been cited for anti-money laundering lapses or sanctions violations.

HSBC's failings date to 2003, when the Federal Reserve Bank of New York and New York state regulators ordered it to better monitor suspicious money flows. In 2010, a consent order from the Comptroller of the Currency (OCC) ordered HSBC to review suspicious transactions. At the time, the OCC called HSBC's compliance program "ineffective."

In 2008, the federal prosecutor in Wheeling, West Virginia, began investigating allegations that a local doctor used the bank to launder money from Medicare fraud.

Ultimately, the prosecutor's office came to believe the case was "the tip of the iceberg" in terms of suspicious transactions conducted through HSBC, according to documents reviewed by Reuters and reported earlier this year.

Cheerleading Injuries | lasvegaschiropractorpeterrandall - befell fundy

Cheerleading injuries are not high in public awareness compared with those of other sports. Cheerleading is commonly seen as a recreation rather than a sport, but in the United States it is slowly being recognized as an aggressive sport in its own right, and there is more understanding of the similarities with other sports. Cheerleaders need the strength of football players, the grace of dancers and the abilities of gymnasts.
As with any sport, cheerleading also carries a risk of injury.

'DWTS' Maks: I won't dance with Honey Boo Boo

Craig Sjodin / ABC

By Ree Hines, TODAY contributor

If Alana "Honey Boo Boo" Thompson was hoping viewers would one day get a chance to redneckonize her dance floor moves alongside ballroom bad boy Maksim Chmerkovskiy, she's bound to be disappointed. The "Dancing With the Stars" pro has no intention of waltzing his way to a mirror-ball trophy -- or anything else -- with the TLC reality star.

"She can go ahead and do ('Dancing')," Maks recently told "Extra." "I'm just never going to dance with her."

Ouch.

Plenty of polarizing reality TV personalities have hit the floor on the ballroom bash before, including multiples' mom Kate Gosselin, "Jersey Shore" star Mike "The Situation" Sorrentino and former teen mom Bristol Palin. But just how likely is it that the "Here Comes Honey Boo Boo" tyke would really get a shot? According to Maks' little brother, Val Chmerkovkiy, who made it all the way to the finals on the last season of the show, not very.

"She's like 7 -- who's going to dance with her?" Val asked rhetorically just before he and Maks joked that recent winning pro Tony Dovolani, who's had his fair share of not-so-winning celebs in the past, might be a good pick.

But what about Honey Boo Boo's mom, aka Mama June? At 33, the coupon- and bingo-loving matriarch is certainly old enough to learn some samba hip shakes -- just not from Maks.

"I would not dance with the mother," the elder Chmerkovskiy insisted.

In fact, Maks hopes to see a higher caliber of stars on the show than what "Dancing" fans have come to expect.

"We also have a lot of reports that we need bigger stars, and I concur," he told "Extra." "I think that some, not all, of our stars have been of questionable backgrounds. But I don?t see Honey Boo Boo or any of her relatives having earned the right, because I think it?s an honor to be on the show."

Season 16 of "Dancing With the Stars" kicks off March 18 at 8 p.m. on ABC. The cast of stars has yet to be revealed.?

Do you think Maks has the right idea? Or do you think Honey Boo Boo and her mom would be a good fit for the competition? Share your thoughts on our Facebook page.

Ghana opposition to challenge presidential poll result

ACCRA (Reuters) - Ghana's main opposition party said on Tuesday it would challenge in court the result of last week's election, which gave victory to incumbent president John Dramani Mahama with 50.7 percent of the vote.

New Patriotic Party leader Nana Akufo-Addo, who lost to Mahama in the poll, said electoral workers had tampered with the result of the December 7 vote - which was widely seen as a test for democracy in one of Africa's most stable nations.

"We are taking our matter to the place where the constitution says we should take our matter," Akufo-Addo told thousands of supporters in the same field in the capital Accra where Mahama held his victory party the previous day.

"We are going to put ourselves in the hands of the judges of the Supreme Court and they will decide the fate of this election."

The United States and regional leaders have issued statements congratulating Mahama on his victory and praising the conduct of the election, which observers said was free and fair despite some logistical glitches.

President Mahama, who took over from former leader John Atta Mills after his death in July, said he was not worried by the NPP's legal challenge and was confident supporters of the rival political camps would remain calm.

"Ghana's democracy is solid, and there are constitutional institutions to deal with situations like this," he told Reuters in an interview at his residence in Accra.

Mahama, during his vistory speech on Monday, urged his defeated rivals to drop any grievances and join him "as partners" in making Ghana better.

The gold, oil and cocoa-producing nation has managed more than 30 years of democratic transfers of power, making it an anomaly in West Africa's so-called "coup belt".

But a contested election in 2008, in which Akufo-Addo lost by less than 1 percent, pushed the country to the brink of chaos, with disputes over results driving hundreds of people into the streets with clubs and machetes.

Razer announces crowdsourced specs for upcoming 'Project Fiona' gaming tablet

After Razer easily scored the requisite 10,000 Facebook likes needed to proceed with its "Project Fiona" 10.1-inch Windows 8 gaming tablet, it asked potential players to decide for themselves how to spec it. And here's a shocker: the consensus was to go hardcore or go home. Voters said it should be similar to the prototype with at least Intel Core i5 or i7 processing zip, mid-tier discrete graphics for max pixel-pushing and weight be damned -- twice the heft and thickness of an iPad was a-ok with the group, for power's sake. Detachable controllers were also considered a must (as we thought earlier), and for all that, wannabe gamers on-the-go were willing to pay somewhere between $1,300 and $1,500. A firm ship date has yet to be announced for the device, though a variant has already made it past the FCC -- which usually bodes well for a timely arrival.

US spaceplane set to launch again

A notoriously mysterious military spaceplane operated by the US Air Force is expected to launch for the third time from Florida on Tuesday.

The reusable, unmanned craft is designed to operate in Earth orbit for extended periods; its prior missions in 2010 and 2011 lasted 224 and 469 days.

The US government has been resolutely quiet about its precise purpose, and would not confirm a launch time.

That has prompted fevered speculation as to the craft's ultimate purpose.

X-37B - American military spaceplane

  • Mission: Described as a re-usable testbed for new sensors and other space technologies
  • Length: 9m Wingspan: 4.5m Height: 3m Mass: 5,000kg
  • Origins: Started as a Nasa project in 1999 before being handed to the military in 2006
  • Operating altitude: 180 - 800 km
  • Cost: The budget line for the X-37B programme continues to be classified information

Tuesday's launch had been pushed back from October, delayed by two satellite launches. Patrick Air Force Base in Florida gave notice of a hazard from a launch in a window between 15:45 and 22:15 GMT (10:45 to 17:15 local time).

The X-37B craft, designed by aerospace giant Boeing, shares more than just a passing similarity to the now-retired space shuttle.

It is just a quarter the size of the shuttle, but is launched on a rocket - the Atlas V. It is coated in thermal tiles to withstand the heat of re-entry, after which it lands on its own gear autonomously.

The stated mission of the craft, according to the US Air Force, is an "experimental test program to demonstrate technologies for a reliable, reusable, unmanned space test platform".

But the latest mission in particular sparked speculation that the craft was spying on the Chinese space lab Tiangong-1 - an idea that has since been largely discredited.

If nothing else, it seems the team behind the X-37B is interested in pushing the limit of flight duration far beyond its 270-day specification.

When it returned from its second mission in June, programme manager Lt Col Tom McIntyre said: "We knew from post-flight assessments from the first mission that OTV-1 could have stayed in orbit longer. So one of the goals of this mission was to see how much farther we could push the on-orbit duration."

But any official mission objectives seems set once again to remain secret.

How to Select an Awesome Domain Name For Your Blog

Having an awesome domain name is a vital component of your branding and essential for creating a positive online presence for your blog.?Once you decided to launch a brand new blog, you should come up with a great domain name for it.

You need to think about the name that you want to call your online baby. You should pick a proper domain name because it can influence your site?s future success or failure. Well, perhaps not that drastic, but it?ll have a great deal of impact on your website for sure. As a matter of fact, it used to matter a bit more before the Google EMD algorithm update, but picking the right name can still either help your blog or keep you back from success. I?m going to list a few crucial factors that you need to keep in mind while selecting a domain name for your new blog.

Domain Name with .com TLDPicking an Awesome Domain Name

Got a .com Domain Name

In the first place, you need to make sure that your future site has a .com TLD. In case you?re not in the know, TLD stands for Top Level Domain. Though having .net or .org TLDs is still OK, you really need to do your best and get the .com one, because ? like it or not ? the audience is just used to the fact that a site should have the .com in the end.

That holds true even more if you want to run a really reputable site. How many non-.com sites can you give me right off the top of your head?

I?m personally having a hard time with coming up with at least one example. And that?s for a reason. For starters, bad habits die hard. And secondly, that?s just how things are on the Web nowadays.

Got a non-.com Domain Name

In case you were not that lucky to get a .com domain name, you need to emphasize that fact whenever possible so that your prospects or just visitors go to your site rather than to someone else?s. And that brings me to another point, which you need to keep in mind. If you could not obtain the .com version of your domain name, you need to really make sure that the site that got that .com TLD is not your direct competitor.

That?s because you don?t want your potential clients to go to your competitor?s site every time they misspell your site domain name (typing .com instead of your non-.com domain name). Plus you?ll have to compete with them even in your company name rankings in Google?s search engine pages. And chances are, the score will most likely be not in your favor if you are not a .com site. I?m not saying that it?ll happen for sure, but you just give another reason to Google for it to happen. What you really want is get your site easy to find so that you can drive traffic to it.

Easy Name

Another idea to be aware of is that your domain name should be really easy to type for the user. If it?s the case, you?ll get less mistypings and consequently less customers that went to a different site just because you did not take the time to come up with a more user friendly domain name.

There?s even a science that studies keyboard keys that are the easiest to type with. Plus we all like everything easy because it means that we won?t have to waste our time on a steep learning curve. Even if it?s a really small one.

Easy to Recall

That?s similar to the previous point but it?s more about the ease of keeping your website address aka domain name in your mind. While thinking what name to use for your site, you should also consider how easy or hard it?ll be to actually memorize your domain name. Long story short, you need to use usual letter-combinations or words that are easy for pronouncing and typing. The words that are easy to pronounce are usually easy to remember.

As Short as Possible

It?s not enough if you just know how to make a website in terms of web design and content marketing. You should take the time to make using it a breeze. Since we all are usually in a hurry, respecting your visitor?s time is a priority. In the ideal situation, your visitor should be able to type in just a few letters and hit the Enter key before he sees your site. Plus a short domain name is easier to memorize and recall. Truth is, it?s pretty hard nowadays to find a short .com domain name, though hard does not mean impossible. That?s one of the cases where your vivid imagination can come into play.

Easy-to-Guess Spelling

It goes without saying that you can always spell your domain name, but it?s really cool if you or rather your customers can enjoy a domain name with easy spelling. Firstly, it?ll ensure that your domain name won?t be misspelled every other time. Secondly, you won?t have to waste your time ? especially in a radio ad or the like ? for spelling out your domain name like 3-4 times just to make sure that the listener knows where he?s supposed to go next if he decides to actually give you a chance to sell him some services or products.

No Hyphens and No Numbers

You may be really tempted ? taking into account my previous tips ? to use hyphens or numbers to make your domain name shorter, easy to memorize and type. Although all the above-mentioned tips still hold true, you don?t really need to go too far with them. Both hyphens and numbers can confuse your potential audience. So, it?s a total no-no. For example, you may call your site mysitename4you.com or mysitenameforyou.com, and if the actual name is the first option, chances are you may land in hot water and pretty fast. How will the visitor know how exactly he?s supposed to spell your domain name? Don?t take it for granted that they will just know. Your visitors are clever people, but most likely they are not fortune tellers.

Look and Sound Good

Since you?re about to run (or already running) an online business, you also should keep in mind the idea that your domain name should have commercial appeal. That translates into being perceived by the target audience in a positive way. Let me break it down for you with the help of an example. Say, you want to launch a site in Mexico and call it ?nova.com?. The problem is that ?no va? means ?no go? in Spanish. So, you can get a problem like that, seemingly out of nowhere. Other than that, you need to remember that different colors, words and objects have a wide variety of meanings in different cultures.

No Slang

In most cases, you need to avoid using slang words in your domain name, although it?s still an option if you?re sure that your target audience will just absolutely get and love it. The first example that jumps into my mind is digg.com. It?s both short, easy to memorize, easy to type, though slang is definitely in use.

The thing is that digg.com was founded by Kevin Rose like 10 years ago or so. Those were the times when it was really easy to register a domain name like that. And it?s a bit different in our day and age. So, stick with standard English words. :)

Exact Match (or Discoverable) Domain Name

Like I said in the very beginning of the post, it used to be pretty beneficial to have an exact match (aka discoverable) domain name, because it helped you to rank better for your target keywords. Though using such a domain name won?t hurt you, it won?t help you a great deal either. What I?m trying to say here is that you should not dwell too much on coming up with a domain name that has your keyword in it. Having such a domain name won?t give you a huge advantage any more. So, better invest your valuable time in taking into account the other factors that really have an impact. And make sure to focus foremost on the quality of your site, both in terms of content and design.

Brainstorm it

In case you really want to use relevant words (keywords) in your blog?s domain name, just think about the ones that describe what your site is going to be about. Try to use synonyms and your keywords to come up with something that looks and sounds both good for the user and the major search engines.

I really want to mention that Ms. Ileane did a really great job with her BasicBlogTips.com, because the name says it all in this particular case. I mean it?s enough to just see the domain name and you can say right off the top of your head what Ms. Ileane?s blog is all about. Kudos to you, Ms. Ileane. That?s an amazing example of the idea that I?m trying to convey here.

One of a Kind

You need to do your best to use a really unique name in your website address. Don?t just use a plural form or a misspelling of a reputable site. It?s dirty pool in the first place. And you just won?t be able to build a rock solid and high profile online business with such naming conventions. :) Just make your domain name really unique. It is supposed to be so exclusive that people just won?t be able to take it for something else.

In Conclusion

It all boils down to the idea that you need to make your domain name convenient and memorable for the end user. Once all those conditions are satisfied, you can think about SEO. And definitely not the other way around, because doing so won?t give you any advantages. You don?t need to create a site for robots or aliens. Your target audience is people with their emotions and habits. Plus chasing the Google algo is a bad idea because the only thing that is not changing in it is change itself.

What about you? How did you decide on the domain name for your blog?
