Morgan Stanley sued for alleged mortgage bias

The American Civil Liberties Union sued Morgan Stanley on Monday, in what the group said is the first lawsuit against an investment bank alleging racial discrimination over packaging subprime mortgage loans into securities.

The lawsuit alleges Morgan Stanley encouraged a unit of now-bankrupt New Century Financial Corp to target black borrowers disproportionately with loans that had a strong possibility of foreclosure and unjustifiably high costs. Morgan Stanley received significant fees from packaging and selling these loans as securities to institutional investors, while the borrowers faced high risks of default, the ACLU said.

"With this lawsuit, real victims of the subprime lending scandal are stepping forward to hold investment banks like Morgan Stanley accountable for the devastation the banks wrought in their lives and in our economy," ACLU Executive Director Anthony Romero said in a statement.

A Morgan Stanley spokeswoman had no immediate comment on the lawsuit.

The complaint was filed in U.S. District Court in Manhattan on behalf of five Detroit residents. It alleges that Morgan Stanley went beyond the traditional role of an investment bank by helping to fund loans made by New Century, setting loan volume goals and establishing terms of the loans.

The ACLU asked the court to certify the case as a class action. It said as many as 6,000 black homeowners in the Detroit area may have suffered similar discrimination as a result of being offered loans that many could not afford.

The alleged practice twists past claims that banks engaged in "red-lining," or refusing to provide loans and other services in low-income areas.

"These loans were mass produced and they were built to order, not to serve homeowners," Elizabeth Cabraser, a co-counsel for the plaintiffs, said at a news conference Monday morning. "It's reverse red-lining. It violates the Fair Housing Act."

Discriminatory practices connected to the securitization process were endemic during the last decade throughout much of the financial services industry and across the nation, the ACLU said.

Critics of securitization, in which banks package loans into securities for sale to sophisticated investors, say it allows banks to be reckless in their credit policies because they do not end up holding the loans. Advocates say that by removing loans from bank balance sheets, it allows them to stimulate the economy by extending credit across a variety of sectors.

Trillions of dollars of mortgage, credit card, automobile and other consumer loans have been securitized and sold to investors. Many of the home loans bought by the banks are insured by agencies such as the Federal Home Loan Mortgage Corp., or Freddie Mac, and Federal National Mortgage Association, or Fannie Mae.

The ACLU lawsuit follows a spate of new litigation against Wall Street by U.S. federal and state authorities over banks' roles in triggering the financial crisis that began more than four years ago.

JPMorgan was sued by New York State Attorney General Eric Schneiderman for alleged subprime mortgage abuses at an investment bank that it purchased during the financial crisis. The U.S. attorney in Manhattan filed fraud charges against Wells Fargo Corp two weeks ago for a "reckless pattern" of making questionable home loans that allegedly cost government hundreds of millions of dollars in insurance settlements.

Massachusetts earlier sued Morgan Stanley for securitizing home loans, alleging violations of a state consumer protection law. The ACLU said that case did not address the issue nationwide nor link the alleged abusive practices to discriminatory policy.

Lawyers for the plaintiffs also include the National Consumer Law Center and Lieff Cabraser Heimann & Bernstein, a San Francisco-based law firm.

The case is Beverly Adkins et al v Morgan Stanley, U.S. District Court for the Southern District of New York, No. 12-7667.

Pastor Steve Youngblood, of the City Church in Burlington, Iowa, said he wanted to ?slap? an unidentified woman during his Oct. 7 sermon after she raised objections to political fliers that were being distributed at the church (video below).

The fliers called for the removal of Iowa Supreme Court Justice David Wiggins, one of the four justices who overturned a law banning same sex marriage in Iowa, reports the Associated Press.

The woman contacted the group 'Vote Yes To Retain Iowa Supreme Court Justices,' which later filed a complaint with the Internal Revenue Service, reports RawStory.com.

Under a 1954 federal law, it is illegal for tax-exempt organizations, including churches, to promote political candidates or ballot issues.

In his Oct. 7 Sermon, Pastor Youngblood said he would ?like to slap her? and that her husband should ?correct her.??

Pastor Youngblood also said: "Don?t call yourself a Christian and do that. We need to draw a line in the sand. We need to begin to say that at City Church this is how we?re going to be.?

"What makes me madder is that this person?s husband won?t correct them. I don?t like rebellious women. I don?t like rebellious men, either. They?re even worse."

The Alliance Defending Freedom has offered to provide Rev. Youngblood with legal representation if the IRS decides to take action.

A new ?cash for access? scandal involving British military?s retired top brass has emerged putting pressure on the UK?s already unpopular army, local media reported

The scandal, revealed in a?Sunday Times?investigation, involves retired high-ranking military officers, who are filmed claiming they can influence lucrative arms deals worth millions of pounds as lobbyists, despite Ministry of Defence (MoD) regulations banning the practice.?

The three-month investigation by the paper has been carried out by reporters posed as representatives of arms manufacturing companies.?

Retired military figures including General Lord Dannatt, the former head of the army, and Lord Stirrup, former chief of the defence staff, from among others have been filmed claiming they could give weapons manufacturers influence in?
Whitehall and Westminster in?return?for six-figure sums.?

According to the paper, Lieutenant General Sir John Kiszely, former head of the Defence Academy, claimed he could use his role as president of the Royal British Legion to influence his clients? agenda with the Prime Minister.?

Meanwhile, Lieutenant General Richard Applegate, a former Ministry of Defence procurement chief, reportedly described a secret lobbying campaign in parliament for a ?500million military programme on behalf of an Israeli arms company.?

It was also reported that Admiral Sir Trevor Soar, Commander of the naval fleet until March 2011, told undercover reporters he would ?ignore? the two-year ban imposed on lobbying ministers.

Lord Dannatt, the former head of the army, also talked about ignoring a ban on discussion of a ?400m contract by ?targeting? the MoD?s top civil servant, with whom he went to school.?

This comes as Prime Minister David Cameron vowed to tackle acts of lobbying before he came to power in May 2010 general elections.?

Britain?s top?universities?have received at least ?83m worth of funds from firms involved in the arms trade over the last three years, The Huffington Post UK can disclose.

Data released by the Campaign Against The Arms Trade (CAAT) has revealed the elite Russell Group universities, including Oxford and Cambridge, gain millions in research and sponsorship money from companies which manufacture weapons.

The figures come amid concerns among activists that cash-starved institutions are helping to promote the manufacture of weapons by accepting such funding.

But the Russell Group said universities took pains to make sure all partnerships were ?appropriate?.

CAAT analysed data?obtained under Freedom of Information requests, which asked for the amount of funding for research and from sponsorship the 24 Russell Group universities derived from private arms companies and the ministry of defence?s research arms from 2008-11.

Private companies provided ?62.8m of the money to the Russell Group universities with the rest coming from the Ministry of Defence.

Of the 18 out of 24 universities that responded, only one, the London School of Economics ? said it received no such?funds.

Of the others it found Imperial College London received the most funds from government and private military sources at ?15.2m, followed by Sheffield and Cambridge, both with ?13.7m and Oxford with just over ?9m.

Oxford University received research?grants?worth ?319k in 2008 to 2009, ?196k from 09-10 and ?199k in 10-11 from BAE systems, one of the world?s largest military contractors.

Cambridge University took ?75,000 of sponsorship money from GKN, which makes both commercial and defence related aircraft, to fund their GKN Chair of Manufacturing Engineering in 2009.

CAAT told The Huffington Post UK it was a problem for universities to be associated with arms companies because ?any link that a university has with an arms company provides that company with a veneer of respectability and sends a message that the arms trade is a legitimate one?.

The group is urging military funding for universities to be at the very least debated, raising concerns that institutions are advocating the arms trade by accepting money from companies involved with the military.

Their concerns are shared by ethical group Scientists for Global Responsibility.

Executive Director Dr Stuart Parkinson told The Huffington Post UK: ?Arms companies fund university research for three key reasons: to gain a competitive advantage on commercial rivals; to create a sympathetic audience among scientists and engineers; and to recruit the next generation of professionals to develop new weapons systems.?

CAAT media coordinator Kaye Stearman told The Huffington Post UK the figures were likely to be an ?underestimate? because some universities refused to answer, and others withheld information due to ?confidentiality clauses?.

?For some universities the funding is a major element in determining research priorities in areas of engineering and?science,? she added.

Imperial University told The Huffington Post UK their yearly research income was ?almost ?300m? and the amount it received from companies and organisations in the defence sector represented around one and a half percent of that.

At Cardiff University, BAE, Rolls Royce, the world?s second largest provider of defence aero-engine products, and GKN have each sponsored students on an MsC in Lean Operations, for manufacturing managers, in the last three years.

Professor Martin Kitchener, Associate Dean at Cardiff Business School said companies had supplied students from the course. ?Those students may or may not have come from the military divisions of those conglomerates. Researchers in the school have conducted research in those companies.

?We have ongoing discussions about ethics within the school and last year we were approached by British American Tobacco looking to put students on our courses and we said no to them.?

CAAT?s Starman said military funding is ?more than just another form of commercial sponsorship? and should at least be debated.

?The ethos of education, which is to support learning and thereby create a better educated and more productive society, is undermined by the war, destruction and waste engendered by the manufacture and trade in deadly weaponry.?

York University, which has received ?3,961,357 since 2008 from arms companieswas forced to pass an ethical investment policy in 2009 after controversy about its dealings with the arms trade.

York University graduate Chris, 24, told The Huffington Post UK he thought such companies evaded ?moral scrutiny?.

?The research conducted at universities helps arms companies to develop weapons which are then sold indiscriminately to governments and armed groups across the world.

?Universities must start to take seriously their duty as institutions of education to promote peace and understanding, not to advance the commercial interests of those who thrive on war and corruption.?

A spokesperson for Oxford told The Huffington Post UK the university: ?Only enters into funding contracts with companies that abide by relevant UK and international obligations in the area of arms manufacturing, and the University does not accept funding from organisations whose activities would be illegal under UK and international laws?.

A Russell Group spokesperson said: ?Like all world-class universities Russell Group institutions collaborate with a number of public and private sector companies on a wide range of leading research projects, including in the defence sector. All our universities have robust systems in place to ensure any partnerships are appropriate.?

A spokesperson for Cambridge University said they had nothing to add to the Russell Group?s comments.

Microsoft Offers Free Music Streaming, With Limitations

Microsoft on Monday is announcing new details of a plan to overhaul its online music service, including free streaming of digital songs. But there?s a catch.

The feature arriving with the new service, which is called Xbox Music, puts Microsoft in the ranks of Spotify, Pandora and other ad-based music streaming companies. It will also give Microsoft a selling point over Apple, which dominates sales of downloaded music but has yet to offer free streaming.

Here?s the catch: only PCs and tablets running Windows 8 and Windows RT, the operating system due out Oct. 26, will have access to the free streaming feature of Xbox Music.

Xbox Music is expected to supplant Microsoft?s Zune music service, which shares the name of the ill-starred portable music players Microsoft stopped selling last year. Besides hardware running the new operating systems, the service will be available on Xbox 360 videogame consoles and handsets running Windows Phone 8.

The service gives subscribers?at a price of $9.99 a month?the ability to download or stream songs on an ad-free basis. Microsoft, which styles Xbox Music as the first ?all-in-one? music service, also will include an online store for downloads, the ability to synchronize playlists across devices and artist-based online radio stations, a feature made popular by Pandora.

Microsoft had said earlier this year that Xbox Music was coming, but had not disclosed the free-streaming plan. It comes with another gotcha: customers will only have unlimited access to the free ad-based music service for six months, after which Microsoft may begin imposing restrictions on how many hours of music can be streamed.

Jerry Johnson, head of Microsoft?s music efforts, said he is committed to offering a free music streaming service. However, he said, ?We acknowledge that free terms and conditions may evolve over time based on industry standards.?

It?s not a first for Microsoft to offer new services that only work with new operating systems. But linking Xbox Music to Windows 8 and Windows RT does limit its immediate reach.

Microsoft?s Zune service was compatible with hundreds of millions of computers running Windows XP, software Microsoft released more than a decade ago, as well as Windows 7, Windows Phone 7 and the Xbox 360.

Owners of PCs running older software won?t have access to the new service at the outset, nor will people with Apple?s mobile devices or those running Google's Android operating system.

Microsoft said it plans to offer software that will connect Android and Apple devices to its Xbox Music service within the next year, but declined to comment about a specific date, nor whether that software was currently in development. Microsoft also said it plans to offer a way to access its software over a website within a year as well, though it wouldn?t offer specifics. Users of older versions of Windows that subscribe to the Zune music service will keep using it until they upgrade to Microsoft?s new operating systems, at which point their subscriptions will shift to Xbox Music, the company says.

Any unique selling point over Apple may not last long. The Wall Street Journal in September reported that Apple was in talks with music companies to create a streaming music service.

An Apple spokesman said the company offers more than 26 million songs on its service and has tallied north of 400 million registered iTunes accounts. Microsoft declined to say how many customers it has currently registered with its Zune music and video service.

The software giant says it has forged agreements with ?dozens? of record labels, but it declined to say exactly how many record labels it has signed deals with for its Xbox Music service, nor how many it had made agreements with in the past. The company did say four of the biggest music labels Sony , Warner Bros., Universal Music and EMI had signed contracts and added their tracks to the collection of about 30 million tracks globally, 18 million of which will be available in the U.S.

Other new features Microsoft says will be available on its service include an upcoming ability to share listening tastes on social networks, receive song recommendations based upon customer?s listening habits, and a forthcoming ?match? service similar to what Apple began offering its customers last year. The feature, which Microsoft tentatively calls ?scan-and-match,? will read a customer?s music library, replicate it in the Xbox Music service, and store any songs Microsoft doesn?t have in its servers to make them accessible from anywhere.
