SAN FRANCISCO (AP) ? A group of city officials, consumer advocates and a state lawmaker on Wednesday attacked California regulators' decision to hire former U.S. Sen. George Mitchell to oversee private settlement talks over a deadly pipeline explosion, calling the process an unfair backroom deal.
The California Public Utilities Commission announced Monday that Mitchell had been appointed to help energy regulators and Pacific Gas & Electric Co. reach a settlement over how much the utility should pay in connection with the San Bruno blast.
Eight people died and 38 homes were destroyed in the gas-fueled inferno that tore through the bedroom community of San Bruno on Sept 9, 2010 after one of PG&E's pipelines ruptured.
Attorneys from the cities of San Bruno and San Francisco, as well as the commission's own consumer advocacy branch, known as the Division of Ratepayer Advocates, said they were not consulted about Mitchell's appointment until days after the commission decided to hire him as a mediator and told PG&E about the decision.
The commission did not immediately respond to questions about how or when the agency hired Mitchell, and the former senator's law firm did not immediately return calls and emails seeking comment.
Commissioner Mike Florio said in an interview he felt the move to inform PG&E first had not been well thought out.
"I think we handled this rather poorly. Announcing it before people were brought into it was not a good idea," Florio said.
Over the past two years, the company has faced grueling public hearings over potential malfeasance leading up to the blast.
One proceeding, chaired by Florio along with commission President Michael Peevey, was intended to determine the level of fines PG&E would face. But a commission judge suspended the hearings last week to instead hold a fresh round of talks between PG&E and other parties.
Peevey said holding closed-door negotiations could lead to a quicker settlement.
Consumer groups said they feared that moving from a public process to private talks chaired by Mitchell would favor PG&E and help the company whittle down possible fines that could reach hundreds of millions of dollars.
"Why not finish the hearings?" said Karen Paull, a lawyer for the Division of Ratepayer Advocates. "Instead, we are being treated like mushrooms ... Feed them manure and keep them in the dark."
In a letter filed Wednesday, the organizations said they don't question the talents of Mitchell ? who brokered the 1998 Northern Ireland treaty and spent two years as President Obama's special Middle East envoy ? but are concerned that he and his law firm, DLA Piper, previously have represented public utilities.
PG&E declined to comment on the group's concerns but earlier this week praised the news of Mitchell's hiring.
"We are committed to resolving this as quickly and fairly as possible for all parties," said PG&E spokesman Todd Burke. "We've supported negotiations that lead to a universal settlement."
Any decision on fines brokered by Mitchell ultimately will be considered by the full five-member commission.

Oct 18 (Reuters) ? Hurry up and wait ? that?s what some
financial advisers are telling their clients as an uncertain tax
environment makes it tough to plan charitable giving in 2012.
Some clients may want to give big now because the charitable
gift tax write-off is among the deductions that may become a
casualty of tax reform. But tax rates for the wealthy could jump
next year, in which case they?d want to set aside deductions for
2013, when the deductions potentially would be worth more.
Given the uncertainty, it?s a good idea to have clients hold
off on big gifts until late in the year in hopes that there will
be more clarity after the elections, tax experts say.
?Why not have all the best information before you make a
significant decision?? suggested Mark Blumenthal, chairman of
the family office practice at Plante Moran, a Midwest regional
accounting firm.
Still, there are things that should be done now to lighten
your workload for the last few weeks of the year.
HYPOTHETICALS
First, map out four or five strategies for charitable
clients, built around possible election results.
The election comes just before the Bush-era tax cuts are set
to expire, unless Congress decides to extend them. T his means
the rates for all income tax paying Americans would increase at
year end. Additionally, those who make about $177,000 and up
would also see their itemized tax deductions cut.
President Barack Obama supports maintaining ordinary income
tax rates for families making less than $250,000 annually. For
incomes above that level, he favors raising the top two tax
brackets to 36 percent and 39.6 percent. Those rates are now at
33 percent and 35 percent. He?d also like to cap itemized
deductions at 28 percent of adjusted gross income for wealthy
families.
Republican Mitt Romney has promised a 20 percent income tax
cut for all Americans, a move he said would be revenue-neutral
because he?d offset it with caps on deductions. He has floated
the idea of a cap ranging from $17,000 to $50,000.
Of course, it?s not just a matter of who takes the White
House. You also have to factor in which party wins control of
Congress and the chance that an agreement on taxes will be
reached in a lame duck session.
Mapping out your clients? alternatives could include
scenarios for what they could do if the Democrats win the White
House but lose control of Congress, and vice versa. The same
holds for the Republicans.
This is essentially what Brian Wodar, national director of
nonprofit advisory services at Bernstein Global Wealth
Management, did after a client said he?d hold off on giving his
church a six-figure gift in expectation of getting a bigger tax
benefit next year.
After Bernstein and the client?s tax adviser explained it
wasn?t a given that he?d get a bigger benefit by waiting, the
man decided to split the gift across this year and next.
?All we can do is provide them the landscape within which
they can make that choice,? Wodar said.
TAKING ACTION NOW
Start setting the groundwork for your clients? gifts now.
Everyone involved ?can make better decisions with two months
to go, t han with two days to go at the end of the year,? said
Ken Nopar, a philanthropic consultant to wealth advisers.
Help clients earmark the assets they?d like to donate . After
this year?s stock run-up, appreciated equity holdings are a good
choice as they allow the donor to avoid capital gains taxes.
Also identify clients whose yearly incomes were higher than
usual, like those who sold a business. Tell them that,
regardless of the election, this is a good year for them to take
a big deduction because of their higher income.
If you have clients who need more time to chose the best
places to give, help them set up a donor-advised fund. These
individual accounts give donors a current-year tax deduction on
contributions but release funds on the donor?s timetable.
Though it takes less than a day to set up one of these
funds, do it now so it?s ready to go if things get hectic at
year end. The accounts, which often require an opening deposit
of around $5, 000 to $10 ,000, can be established through
providers like Fidelity Charitable, Schwab Charitable and
Vanguard Charitable and also through community foundations.
Another tip: introduce yourself to the director of gift
planning at a community foundation now, before he or she is
inundated with calls at the end of the year, suggested Jason
Baxendale, director of gift planning with The Chicago Community
Trust. The foundation can help you identify good places for your
clients to donate their money.
Overall there?s no excuse to procrastinate, said Bernstein?s
Wodar.
?Putting it off until we have some kind of certainty with
taxes may literally mean you never ever do planning,? he said.

Some celebs prefer the sunshine and bright lights of Hollywood. Others would rather call the Big Apple home. But wherever they end up, there?s one thing that they all want:
Privacy.
But beyond that, the real estate scenes in New York and Los Angeles differ vastly. We asked two? Manhattan real estate agents to explain a few of the must-haves that celebs look for when they house hunt in New York.
?Just like every New Yorker, location is key,? said real estate agent Prince Dockery. ?They want to be close or en route to performance venues, airports, practice facilities, and they want to be close to where their everyday schedule takes them.?
Popular neighborhoods for A-listers? New York real estate agent Fredrik Eklund says the West Village, SoHo, Tribeca and Bowery areas are currently hot celebrity spots.

Jennifer Aniston bought a West Village penthouse last April. She later sold it, citing privacy concerns.
But no matter where they?re located, stars want to be able to come and go as privately as possible.
Beyond location, celebrities look for features so that ?they don?t have to leave their home if they don?t have to,? Dockery says.
Among the favorites: ?Gym, on-site parking, valet and a space to entertain in rather than going out,? he said.

New York Knicks star Carmelo Anthony's former rental had a spacious terrace.
Outdoor space is another desirable feature, says Eklund, but the challenge is that few private terraces in New York are just that, private.
One of the biggest drawbacks of co-ops is privacy, so celebs prefer condos, Eklund says.
?Unless it?s a newer co-op or fairly lenient co-op that operates more like a condo, many of my celebrity clients prefer to stay away from co-ops,? Dockery said.
But of course, if the co-op is what they want, a celebrity will purchase in their company?s name or work closely with an accountant to preserve privacy.
Space is limited in a city of 8 million, but celebrities, more than others, are looking for extra rooms?? in particular, extra closets.

Ben Stiller and Christine Taylor's duplex, currently on the market, has significant closet space.
Bedrooms, and even kitchens, are transformed for clothes collections, but if all else fails, celebs will find space somewhere else.
?We had a celebrity last year buy five storage units in the building,? Eklund said. ?I guess he had a lot of clothes, and the closets in the apartment were not enough.?
But even with limited space and pricier rents, it?s the vibe and energy of the city that attract celebrities, Dockery says.
And, unlike Los Angeles, the coveted privacy is a bit more attainable.
?Almost anyone with big sunglasses can go unnoticed in NYC and get sucked up by the city,? Eklund said.

Researchers at the Bellvitge Biomedical Research Institute (IDIBELL) and The Institute of Photonic Sciences (ICFO) have collaborated on the development of a diagnostic tool that identifies the metastatic ability of breast cancer cells. The analysis is based on the characterization of the lipid component of the cells, which is indicative of malignancy. This has allowed the researchers to develop a classifier to discriminate cells capable of inducing metastasis. The results of the study have been published in the online version of the scientific journal PLoS ONE.
The characterization of the lipids associated with malignancy has been possible thanks to the technological development of a spectroscopic device named Raman along with the versatility offered by the experimental models of breast cancer. The results of this process form the basis for introducing this technique in routine cytological diagnosis, which could be extended in the future to diagnose other tumours.
The researchers have analyzed the main components and, partly, the less discriminating ones to assess the profile of the lipid composition of breast cancer cells. They have generated a classification model that segregated metastatic and non-metastatic cells. "The algorithm for the discrimination of the metastatic ability is a first step towards the stratification of breast cancer cells using this quick and reactive tool", explains the study coordinator, ngels Sierra, researcher at the Biological Clues of the Invasive and Metastatic Phenotype group of IDIBELL.
Using cytology techniques, the researchers have found a correlation between the activation of lipogenesis (the chemical reaction leading to fatty acids in an organism) and the amount of saturated fats in metastatic cells indicating a worse prognosis and a decreased survival. The lipid content of the breast cancer cells might be a useful measure to determine various functions coupled to the progression of breast cancer. The work has been supported by the Instituto de Salud Carlos III, the former Spanish Ministry of Science and Innovation and the private Cellex Barcelona Foundation.

Apple has been short on its iPhone 5 supply since day one, and it isn't just because they're selling like hotcakes. The shortage may actually be due to the fact that the iPhone 5 is Apple's most complex handset yet, according to a Wednesday report from The Wall Street Journal.?
One of the company's contractors, Hon Hai Precision Industry (which most of us know better by its Foxconn trading name), told WSJ that the supply shortage is actually due to the complicated nature of the product. Here's how he put it:
?The iPhone 5 is the most difficult device that Foxconn has ever assembled. To make it light and thin, the design is very complicated. It takes time to learn how to make this new device. Practice makes perfect. Our productivity has been improving day by day."
Hon Hai has reportedly taken steps to improve its productivity, and has also added a new quality check procedure. But as the official pointed out, there are always limitations. ?It's always hard to satisfy both aesthetic needs and practical needs,? he noted.
Before this we heard that Sharp was part of of the iPhone 5 production problem, as it purportedly had issues churning out Apple's new screens fast enough. But the company eventually responded, stating that its production was perfectly adequate and the reports regarding it were inaccurate.?

WINNIPEG, Manitoba/CHICAGO (Reuters) - The Canadian government said on Thursday that management changes at an Alberta plant responsible for one of the country's biggest-ever meat recalls would not affect a nearly completed review of changes made to improve the plant's safety.
Canadian food inspectors are set to recommend this week when, or if, XL Foods' Lakeside beef processing plant in Brooks, Alberta, can reopen after E. coli contamination of its products sickened 15 people in Canada and prompted the recall of millions of pounds of beef.
The Canadian Food Inspection Agency (CFIA), which pulled privately held XL Foods' operating license on September 27, said "any change in management or ownership at XL will not affect our assessment."
JBS USA, a subsidiary of Brazil-based JBS SA, said late Wednesday it had signed a deal with XL Foods to manage the Brooks plant and had an option to purchase the Canadian and U.S. operations of XL Foods for $50 million in cash and $50 million in JBS SA shares.
The company, which would not assume XL Foods' debt or liabilities, said it would examine events carefully to work out what went wrong at the plant, which can process up to 4,500 head of cattle a day.
"We're going to have to sit down with XL and understand what has occurred in that facility to date and bring our expertise to assist in that situation," JBS spokesman Cameron Bruett said on Thursday.
"We have a very successful food safety track record and robust food safety program and we think that will be an asset to the facility."
JBS has not decided on any specific changes on how the plant will run, he said.
The CFIA this week reviewed the steps XL Foods has taken to improve food safety.
Agriculture Minister Gerry Ritz, who has been under fire for the government's handling of the beef recall, also suggested nothing will change in the review timetable.
"Canadian consumers can be assured that the Canadian Food Inspection Agency will enforce the same rigorous food safety standards at Lakeside facility regardless of the management," Ritz said in an email statement.
"(CFIA) has concluded their last stage of review and I look forward to receiving their report which will outline the next steps for this facility."
JBS HIT BY BEEF RECALL IN 2009
JBS has also produced beef contaminated with E. coli. The U.S. Department of Agriculture's Food Safety and Inspection Service in 2009 recalled beef produced by JBS Swift. Twenty-three people in the United States were infected.
JBS responded by assembling a top-notch food safety team that still advises the company, said Steve Kay, editor of California-based Cattle Buyers Weekly.
"What they do will absolutely diffuse the whole issue and all the controversy surrounding the recall because their focus will be 150 percent on satisfying CFIA's requirements and enhancing the food safety systems currently in the plant and getting it back up and running by early next week if they can," Kay said.
JBS will decide whether to buy the XL operations within six months, Bruett said. If it does, it will be its first purchase of a processing facility in Canada.
In Canada, JBS, the world's sixth-largest exporter of beef and veal, would go toe to toe with Cargill Ltd, which operates two big beef plants of its own.
"Canada has an excellent cattle herd," Bruett said. "Our strategy as a company is to have a global platform both in processing and in distribution."
The temporary shutdown of XL Foods' plant has forced ranchers and feedlots to hold back their cattle from market, racking up additional costs, or to export them to U.S. slaughter plants.
Western Canadian feedlot operator Brad Wildeman said he would be sorry to see a Canadian cattle company disappear, but sees benefits from JBS's arrival.
"They have a lot of expertise at running plants and second, they're a world trader, so in the longer term our ability to build export markets is going to be important for us."
JBS is the third biggest beef producer in the United States, after Tyson Foods Inc and Cargill.
"This whole deal with picking up XL assets, which is eventually what they are going to do in six months, reveals JBS's opportunistic acquisition strategy and strengthens their hand in North America quite considerably," Kay said.
Bruett would not say when the company began discussions with XL Foods, which is privately owned by Nilsson Bros.
JBS shares in Sao Paulo rose 3.8 percent in afternoon trading.
