Panera net income rises in 3Q, co. ups outlook

ST. LOUIS (AP) ? Shares of Panera Bread rose 5 percent in aftermarket trading on Tuesday after the company reported third-quarter net income rose 27 percent on strong demand for its soups and sandwiches. Panera also raised its fourth-quarter earnings projection.

St. Louis-based Panera and other fast-casual chains like Chipotle have been gaining in popularity in the U.S. and are seen as a step up from traditional fast-food chains. However, worries about slowing growth at Chipotle have put a damper on investor enthusiasm for the sector.

Net income rose to $36.5 million, or $1.24 per share. That compares with $28.8 million, or 97 cents per share, last year. Analysts expected $1.19 per share, according to FactSet.

Revenue rose 17 percent to $529.3 million from $453.1 million last year. Analysts expected $522.3 million.

Revenue at restaurants open at least a year, a key metric of a restaurant chain's financial health, rose 6.2 percent at company-owned locations and 5.5 at franchised locations.

For the fourth quarter, the company now expects earnings of $1.72 to $1.74 per share, up from $1.66 to $1.70 per share. Analysts had expected $1.69 per share.

For 2012, the company now expects net income of $5.86 to $5.88, up from $5.72 to $5.78. Analysts had expected $5.78 per share.

The company expects full year 2013 net income of $6.85 to $7, while analysts expect $6.90 per share.

Shares of Panera rose $8.16, or 5.1 percent, to $168.50 during aftermarket trading. The stock fell $1.37 to close at $160.34 during regular trading.

AP Exclusive: France sends drones for Mali crisis

PARIS (AP) ? France is moving surveillance drones to west Africa and holding secretive talks with U.S. officials in Paris on Monday, as France seeks to steer international military action to help Mali's feeble government win back the northern part of the country from al-Qaida-linked rebels, The Associated Press has learned.

France and the United Nations insist any invasion of Mali's north must be led by African troops. But France, which has six hostages in Mali and is said to have citizens who have joined al-Qaida in the Islamic Maghreb, is playing an increasing role behind the scenes.

Many in the West fear that northeast Mali and the arid Sahel region could become the new Afghanistan, a no-man's-land where Islamists can train, impose shariah law and plot terror attacks.

"This is actually a major threat ? to French interests in the region, and to France itself," said Francois Heisbourg, an expert at the Foundation for Strategic Research, a partially state-funded think tank in Paris. "This is like Afghanistan 1996. This is like when Bin Laden found a place that was larger than France in which he could organize training camps, in which he could provide stable preparations for organizing far-flung terror attacks."

France has been turning more attention to the Sahel just as it is accelerating its pullout of combat troops from Afghanistan ahead of other NATO allies.

A French defense official said Monday that France plans to move two surveillance drones to western Africa from Afghanistan by year-end, though he did not provide details.

Top-level American and French military leaders and diplomats, including U.S. assistant secretary of state for African affairs Johnnie Carson, began two days of talks in Paris on Monday on intelligence-gathering and security in Mali and the rest of the Sahel region, officials from both sides told the AP.

The officials spoke on condition of anonymity because they weren't authorized to talk publicly about the activities.

The Paris meetings follow a U.N. Security Council resolution that gives Secretary-General Ban Ki-moon about a month to help Malian authorities devise a plan to regain control of the north. And on Friday, African leaders met in Bamako, Mali's capital, to prepare a plan for a military intervention in the north ? seized under the cover of a coup d'etat there six months ago.

The Hitler Shield: Mocking the Dead at Facebook

Facebook is sliding into moral decay. I would say slowly, but the pace of detrimental change appears to be increasing.?The change between 2008 and today is truly shocking; the more facebook grows, the less regard it appears to have for other or for society as a whole. In 2008 Facebook?s terms of service included a prohibition on content that was ?racially, ethnically or otherwise objectionable?, which was removed later that year as part of an effort to ?simplify? Facebook?s rules. Until 2012, Facebook? regulations included? a general prohibition on ?hateful? content, the last bastion against hate that survived the 2008 purge of ethical regulations.? This year, that prohibition was reworded to only cover ?hate speech?: the difference is significant,? as hate speech only protects against hate directed at specific minority groups ? in other words, a much narrower protection.

In 2011, a Facebook spokesperson told the BBC that, ?the vital distinction was still between controversial discussion and genuine attempts at humour on one hand, and obvious hate speech on the other, but that content targeting a particular minority would always be removed.? This year, however, as the Online Hate Prevention Institute has reported, Facebook has refused to remove multiple pages dedicated to hate speech against Aboriginal Australians saying, ?while incredibly distasteful, this content currently does not violate our terms?. They acknowledged the content may breach Australian anti-discrimination laws, adding, ?while we do not remove this type of content from the site entirely unless it violates our Statement of Rights and Responsibilities, out of respect for local laws, we have restricted access to this content in Australia via Facebook.? That?s a huge backwards step.

Even before these move to normalise online hate, Facebook had one special exception: Holocaust denial. Though the reasons changed over time, Facebook has always maintained that Holocaust denial ?as such? was neither hateful nor hate speech. As Matthias K?ntzel explained, ?Facebook seem to be viewing Holocaust denial as an expression of ignorance ? a kind of intellectual error?, he added that ?in the world of social networking, ideas gain legitimacy simply because they are discussed?, so this approach is ?not only wrong, but also dangerous?. Facebook?s position on Holocaust denial means the best way to protect hateful content on Facebook against removal appears to be linking it to the Holocaust, a tactic I will call the ?Hitler shield?. This shield threatens more than just the Jewish community.

One of the clearest uses of the Hitler Shield is the page ?R.I.P Hitler (Suicide Awareness)?. The page?s description is quite clear: ?It must be specified this is in no way a ?white empowerment? page. The sole purpose of this page is to mock the ?R.I.P Amanda Todd? pages and in no way do we support Hitler, the Nazis or hate towards Jewish people.?? One the one hand, this page clearly states its aim of mocking the memorial pages for a 15 year old girl, driven to suicide as a result of cyberbullying. On the other, we have the classic Antisemitism 2.0 introduction, that is, one which denies its antisemitic nature even as it promotes antisemitic ideas.

Let?s begin with mocking the death of Amanda Todd.? For those that haven?t seen it, Amanda?s video can still be seen on her YouTube account, and it?s worth watching. It shows the face of modern evil - of those who would abuse technology to destroy a life.? It depicts the brave struggle of this young Canadian girl faced with bullies who attack her online, and then in the real world. They followed her with their attacks over a period of years, and even across the country as she moved between schools and cities. She discussed her failed suicide attempt, how she was mocked and needled to try again. She did. She died. Now she is greatly missed by all who knew her, and by many who didn?t.

In Amanda?s video, she speaks of her failed effort to kill herself by drinking bleach. She shares how - six months after this - people were still posting pictures of bleach and tagged her so they appeared in her profile. She shares how one person said ?She should try a different bleach, I hope she dies this time and isn't so stupid?. Such hate has no place in a civilised society. It has no place in social media. Yet now, on the ?R.I.P Hitler (Suicide Awareness)? we have an image of Hitler with a bottle of bleach edited into his hand and the comment ?Hitler shouldn't have to do this just to be remembered like Amanda. Don't worry pal, we remember.?? The revulsion I feel personally at this image has nothing to do with the glorification of Hitler. The use of the very sort of image that led to this young girl?s death to mock her memorial pages is callous beyond belief. I strongly doubt the page owner would dare post such a picture under their own name. At an absolute minimum Facebook has to stop pages being used to provide anonymity for such behaviour.

On the antisemitism side, we have the page owner posting ?To anyone who hates this page, come over, I just got a new oven and would like to see how powerful it is?. An image of the classic game ?Guess Who? has been digitally altered to read ?Gas who?? Another has a picture of Anne Frank with the text ?This one time at camp, we got so baked? ? an antisemitic meme recently used on a number of other pages on Facebook. The comments by other users are also concerning and suggest Holocaust denial is alive and well in 2012, particularly amongst people in their early 20s. The page itself is most popular in Melbourne, Australia, and with children aged 13 to 17. With its poor response to Aboriginal Memes, Facebook has in recent months dramatically increased the acceptability of online hate in the Australian school yard.? A formal complaint was lodged with the Australian Human Rights Commission against the page by the Executive Council of Australian Jewry, the Australian Jewish community?s peek representative body.

The owner of the ?R.I.P Hitler (Suicide Awareness)? page also makes reference to far-right symbolism. This suggests they are a far right extremist, or someone already exposed to such extremism, and actively trying to use humour as a cover and Amanda Todd as a tool.? The page serves openly as a platform to attract others who find Hate funny, and to draw them towards an antisemitic ideology. The strategy seems to be working, with the page growing to over 28,000 people in less than a week.

?

The viral spread of hate is the ultimate danger of social media. This is why Facebook?s moral decay must stop. Pages are a useful feature, the Online Hate Prevention Institute?s Facebook page is a significant tool in our fight against hate, but the ability to use pages to anonymously promote hate must be removed. There is no right to anonymous free speech - not even in the United States.

?

The Hitler Shield must also be removed: adding Hitler to the mix should not make mocking the memorial pages for fifteen year old Amanda Todd suddenly acceptable. Facebook?s policy on the Holocaust has, perhaps inevitably, led to Hitler becoming a means of white washing hate. We remember the Holocaust to prevent hate becoming accepted in society. There is a message in Holocaust remembrance that Facebook appears to have forgotten.

This is a battle about the future not the past. We must demand the protection of governments from a technology that is turning feral.

Makers of phones and tablet computers have begun releasing results for the latest quarter. Many companies including Nokia and Research in Motion have been struggling to compete with Apple and manufacturers of devices running Google's Android software. Here's a look at how makers of phones and tablet computers are doing.

Oct. 18: Google Inc. says its Motorola Mobility device-making business suffered an operating loss of $527 million, more than tripling from the same time last year, when it was still an independent company. Google is planning job cuts at Motorola, but says it still could take a few years for Google to turn that business around.

Nokia Corp. reports that its third-quarter net loss widened further to ?969 million ($1.27 billion) with a 19 percent plunge in revenue, as it struggles against the dominance of Samsung and the iPhone in the tough smartphone market. Nokia gave a grim outlook for the rest of the year as it prepares for this fall's launch of Microsoft Corp.'s new phone software, Windows Phone 8. The Finnish firm acknowledges it expects no quick gains from the new Windows launch.

Ellen DeGeneres receives top humor prize in DC

WASHINGTON (AP) ? Some of the nation's top comedians hailed Ellen DeGeneres as a trailblazer Monday night as she received the nation's highest humor prize.

The Kennedy Center is awarding DeGeneres the Mark Twain Prize for American Humor. The show will be broadcast Oct. 30 on PBS stations.

"Thanks to everyone at PBS. I am so happy to be part of your farewell season," DeGeneres joked in accepting the prize and taking a jab at Republican presidential candidate Mitt Romney's plans to stop funding public broadcasting.

On the red carpet before the show, DeGeneres said she doesn't see herself as political with her comedy, though, even though she's been a trailblazer.

"I just want to make people happy and make people laugh," she said.

DeGeneres, 54, began her career as a comedy club emcee in her native New Orleans. After a performance on Johnny Carson's show in 1986, he invited her over to his desk to chat. She was the first female comedian to receive that invitation from Carson.

Turning to acting, DeGeneres landed sitcoms on Fox and ABC, eventually starring in "Ellen" from 1994 to 1998. She broke new ground and a taboo in 1997 when she came out publicly as a lesbian and her TV persona then became the first lead character on prime-time TV to reveal she was gay. A record 46 million viewers watched the episode.

Coming out on TV 15 years ago feels like another life, she said Monday night before the show.

"I did it because it was the right thing for me to do," DeGeneres said. "It was the right thing for me to do to not live with shame. I happened to help a lot of people, and it happened to create a ruckus."

Jimmy Kimmel called it a milestone.

"For a lot of people, Ellen is their only homosexual friend," he said. "She's there in their living room every single day."

On stage, he said DeGeneres was his inspiration.

"Because of Ellen, in 1998, I mustered the strength to come out of the closet ? despite the fact that I'm not gay," he joked. "Thanks to Ellen, vests aren't just for magicians anymore."

Sean Hayes said DeGeneres made his former show, "Will and Grace," possible. He said her "fearlessness" was her biggest contribution and that she changed America.

"We didn't have a voice, until there was you," he said before breaking into a rendition of "Till There was You."

"Glee" star Jane Lynch said DeGeneres "took one for the team."

"She's the one who went in there with a machete" and cleared the way for other shows with gay characters such as "Glee," she said. "Look where she is today."

Kristin Chenoweth said DeGeneres has always remained kind.

"She's not a mean girl comic," she said.

When DeGeneres first heard she was receiving the same honor that Bill Cosby, Tina Fey and Will Ferrell won in recent years, she joked, "Why didn't I get this sooner?"

After DeGeneres came out on TV in 1997, the show began to tank and was canceled a year later. The feeling of rejection was enough to send DeGeneres into a depression. Still, "Ellen" paved the way for future shows to feature gay characters, from "Will and Grace" to "Modern Family."

DeGeneres came back with a CBS sitcom, movie roles and even a stint as an "American Idol" judge. Forbes magazine has ranked her as the 47th most-powerful woman in the world and estimated her earnings at $53 million last year.

Her hit talk show that debuted in 2003 is now in its 10th season. Among other achievements, that's where she eventually persuaded President Barack Obama to dance.

"She's brilliantly shined a light on society, and that's what Mark Twain did," said Cappy McGarr, an executive producer for the Mark Twain Prize show, when the award was announced.

The prize honors comedians in Mark Twain's tradition of satire and social commentary. Past winners include Steve Martin, Lily Tomlin and Whoopi Goldberg.

John Leguizamo saluted DeGeneres and PBS for planning to air the show.

"How about that? A gay woman on PBS ? with public money and the Kennedys," he said. "It's like the tea party's worst nightmare."

(AP) ? A U.S. military war tribunal is weighing a question that might seem better suited for a history class than a courtroom: How long has the United States been at war?

The question is more than academic for Abd al-Rahim al-Nashiri, whose lawyers are appearing before the tribunal this week at the U.S. base in Guantanamo, Cuba, to seek the dismissal of war crimes charges that were approved by a Pentagon-appointed legal official.

Al-Nashiri faces trial in a special tribunal for war-time offenses known as a military commission for allegedly orchestrating the bombing of the USS Cole in Yemen in 2000 as well as attacks on two other ships. But his lawyers say that since the U.S. wasn't at war at that time, the 47-year-old shouldn't be tried at Guantanamo.

"The fact of going to war is a decision by the political branches, either Congress or the president or both," attorney Richard Kammen said Monday. "It's not something to be arrived at retroactively by a bureaucrat who is not appointed by Congress because it has huge consequences."

Al-Nashiri's lawyers say that the U.S. wasn't at war until after the Sept. 11, 2001, attacks and then-President George W. Bush did not certify the existence of hostilities of any kind in Yemen until September 2003.

The motion for dismissal is one of 21 matters set for consideration at a hearing that started Tuesday at the base, where the U.S. holds 166 prisoners, most of whom have not been charged with any crime. The hearing is scheduled to run through Thursday but officials were trying to condense the agenda because of the approach of Tropical Storm Sandy, which was heading north in the Caribbean Sea on a track to reach southeastern Cuba on Thursday.

Al-Nashiri refused to attend the hearing, telling a legal official at the prison that he was boycotting to protest the use of belly chains to move him from his cell to court.

The chief prosecutor, Army Gen. Mark Martins, argued that he should be required to attend at least so that he can be questioned about his motivations in open court in case the matter is ever reviewed in later appeals. The judge, Army Col. James Pohl, has previously said al-Nashiri can waive his right to attend pretrial hearing, as he did last week in the Sept. 11 case.

Lawyers for al-Nashiri have said he opposes restraints that remind him of the harsh treatment he endured previously in U.S. custody as well as because he feels the proceedings are pointless since the government could detain him indefinitely even if he were acquitted.

"If he is acquitted he does life without parole in Guantanamo. If he's convicted he gets life without parole or death in Guantanamo," Kammen said. "It's very easy to see somebody saying 'Why do I want to participate in this? I've got no real stake in the outcome.'"

Other items on this week's agenda include whether the U.S. government should turn over information about a man killed in a drone strike in Yemen in 2002 who was identified in some media reports as the mastermind of the Cole attack.

"If he was killed based on the fact that he was the mastermind behind the USS Cole that's relevant," said Navy Lt. Cmdr. Stephen Reyes, his military lawyer.

Al-Nashiri, who was born in Saudi Arabia to a Yemeni father and a Saudi mother, has been held at Guantanamo since September 2006. An allegedly senior member of al-Qaida, he was held for four years in the CIA's secret network of overseas prisons, where he was subjected to the "enhanced" interrogation program that included at least two instances of the simulated drowning technique known as waterboarding. The government has said he was also threatened with a gun and a power drill because interrogators believed he was withholding information about possible attacks against the U.S.

In November, he was arraigned on charges that include terrorism and murder for the attack on the Cole, which killed 17 sailors and wounded 37, as well as for orchestrating the October 2002 bombing of the French tanker MV Limburg, which killed one crewman, and a failed January 2000 plot on the USS The Sullivans. He could get the death penalty at a trial that his lawyers say is at least a year away.

In making the case for the military tribunal, prosecutors lay out the history of what they see as al-Qaida's escalating war against the U.S., starting with an August 1996 declaration by Osama bin Laden calling for the murder of U.S. personnel serving on the Arabian peninsula, though it wasn't until a week after the Sept. 11, 2001, terrorist attacks that Congress and Bush approved an authorization for military force.

Al-Nashiri's lawyers say that former President Bill Clinton repeatedly noted that the country was at peace in the aftermath of the Cole attack.

A group of retired admirals and generals who served as senior military legal officials called for the military charges to be dismissed and for the case to be shifted to a civilian criminal court. In a brief in October as part of a civil challenge to the case, they also argued that the definition of war was being improperly expanded to include non-war offenses in the al-Nashiri case, and that such a use of the military courts could put U.S. soldiers and citizens in jeopardy in the future if other countries did the same thing to them.

"If countries can retroactively decide we were at war and chuck people from the civilian court systems into prisoner of war systems with the attendant lack of protections, that road runs both ways," Kammen said. "Once you get to go back in time and rewrite history that's a very, very dangerous precedent."

Prosecutors say in court papers that it will be up to the jury to decide whether the war crimes were properly filed in this case, and that it's too early for the judge to rule on the question.The judge is not expected to issue an immediate ruling on the motion.

The first thing I do with a review phone after I'm finished writing the review is to try to root it. Tonight was that night with the Sprint Optimus G, and it went rather well.

After a bit of Google Translate, I found the root method for the Korean Optimus G and had to try. It's based (either in whole or in part -- I don't read Vietnamese) on the Ice Cream Sandwich and Jelly Bean adb restore exploit discovered by Bin4ry and does the job easily.
