This makes total sense, because Groupon needs to know where you are, who you’re with and what you’re doing and like, so that it can push more relevant deals to you. CSPI Recommends Consumers Avoid Product Pending FDA Investigation into Deaths

5-hour Energy?the controversial caffeinated supplement drink under federal scrutiny for its reported role in 13 deaths?has at least temporarily stopped running a web-based video ad which the Center for Science in the Public Interest said misled the public about the nonprofit watchdog group's stance on the product's safety. Lawyers for the Farmington Hills, MI-based manufacturer of 5-hour Energy say the ad will remain down while the company "research[es] the legal issues further."

The ad in question featured a quotation from Time magazine in which CSPI executive director Michael F. Jacobson answered a question about whether it is possible to die from caffeine. "It's highly unlikely," Jacobson told Time. "Someone would really have to make an effort to consume 40 or so 200-mg caffeine tablets." CSPI told 5-hour Energy that its use of that quote in its ad gave the false impression that Jacobson or CSPI endorsed the product.

In fact, CSPI does have concern about 5-hour Energy, which contains far more than just caffeine. It also contains citicoline, tyrosine, phenylalanine, taurine, malic acid, glucuronolactone, unspecified natural and artificial flavors, the artificial sweetener sucralose, potassium sorbate, and sodium benzoate.

"People have been drinking coffee and tea for millennia," Jacobson said today. "People have been consuming 5-hour Energy only since 2004. Considering that the FDA is investigating reports of heart attacks, convulsions, and deaths associated with the product, we recommend people not consume 5-hour Energy until the FDA gets to the bottom of the problems."

The company is also under investigation by the New York Attorney General's office, and Representative Edward Markey (D-MA) recently called for a Federal Trade Commission probe into the advertising for 5-hour Energy and other energy drinks. Yesterday, Senator Richard Blumenthal (D-CT) said the recent 5-hour Energy ad quoting Jacobson was misleading and should be stopped.

We've seen a few budget tablets debut at CES this year -- the Vivitar Camelio and Polaroid's M7 among them -- and the latest 7-incher to cross our path is Coby's MID7065. This $150 (not $130, as we incorrectly say in the video) slate runs Android 4.0 and is the first in Coby's lineup to feature access to Google Play.

This device is fully Google-certified in the sense that all of Mountain View's standard programs, such as Gmail and Maps, are on board. There aren't any surprises when it comes to other specs: the MID7065 runs a dual-core Cortex A9 processor clocked at 1.GHz with 1GB RAM, and there's 8GB of internal storage (expandable up to 32GB via the microSD card slot). Other connections include mini-HDMI and a micro-USB port. There's a front-facing 0.3-megapixel camera to the left of the display, and the capacitive panel itself sports a standard resolution of 1,024 x 600.

We spent a few minutes poking around the Play store and flipping through home screens, and we didn't notice any lag. The accelerometer was speedy at recognizing changes in display orientation as well. The MID7065's design isn't the thinnest we've seen, but the plastic body feels sturdy, and the rounded edges are comfortable in the hand. Look for the tablet to drop in the next month or two -- and check out our hands-on gallery in the meantime.

NetSuite Acquires Point-of-Sale Company Retail Anywhere - Arik ...

Zach Nelson of NetSuiteLast year, NetSuite, the cloud software company that helps mid-sized companies run their business, added to the growing list of things offered ?as a service.? Its contribution to that list, announced in May, was ?commerce-as-a-service.? NetSuite?s approach was, and is, managing both the back-end bit of business-to-business commerce and the direct-to-customer type of commerce, in a unified way.

NetSuite called it SuiteCommerce, and it has turned out to be a pretty big deal. In fact, one of its key partners was a smallish company called Retail Anywhere that specializes in point-of-sale terminals and software. Retail Anywhere had decided to build its next generation of POS terminals using SuiteCommerce. Retail Anywhere had created the popular Retail Anywhere point-of-sale app for Apple?s iOS devices. The two companies went to market jointly, and the result was a surprise for at least one of them. ?We crushed them with demand,? NetSuite CEO Zach Nelson told me.

Today, NetSuite announced that it has bought Retail Anywhere. Financial terms aren?t being disclosed, because it?s not material to NetSuite?s finances. Nelson told me that NetSuite and Retail Anywhere had 30 joint customers, but that among its existing customer base, there are 500 companies who consider themselves retailers that could could take advantage of the combined offering. And there are thousands of existing Retail Anywhere customers ? the company has been around for 28 years ? who will get exposed to NetSuite.

One thing that?s not staying, Nelson said, is the point-of-sale hardware business. ?We?re going to get out that business,? he said. Eventually, he says, in-store retail will look a lot more like e-commerce. ?More and more, you?re seeing sales reps walking around stores with iPads, swiping credit cards,? he says.

And things like that are having an effect on shoppers? attitudes. A Deloitte survey conducted during last year?s holiday season found that retailers who had several touchpoints through which to engage with a consumer had a 71 percent of selling to them than those who relied only on the old-school brick-and-mortar approach. What it means is that stores who can reach a customer both online and in person are more likely to sell to them. And that means you need to unify the experience. Pricing and inventory, for example, need to be in sync.

NetSuite is due to report earnings on Feb. 4 later this month. Analysts expect it to report a four-cent-per-share profit on sales of about $83 million, and for it to close its fiscal 2012 with about $307 million in sales. NetSuite shares rose at the open this morning by about 30 cents on the news, to $70.65. The shares rose by more than 66 percent in 2012.

(AP) ? The 16-year-old boy had just wounded a classmate he claimed had bullied him, fired two more rounds at students fleeing their first-period science class then faced teacher Ryan Heber.

"I don't want to shoot you," he told the popular teacher, who was trying to coax the teen into giving up the shotgun he still held.

Recounting the suspect's words, Kern County Sheriff Donny Youngblood said the confrontation was enough of a distraction to give 28 students time to escape their classroom Thursday at Taft High School.

The violence came just minutes after administrators had announced new lockdown safety procedures prompted by the Newtown, Conn., school massacre.

"Just 10 minutes before it happened our teachers were giving us protocol because of what happened in Connecticut," said student Oscar Nuno, who was across campus from the science building when an announcer on the speaker system said the school was under lockdown "and it was not a drill."

The teen victim, who classmates said played football last year for the Taft Wildcats, was in critical but stable condition at a Kern County hospital Thursday night. He was expected to undergo surgery on Friday.

The suspect surrendered his shotgun to Heber and campus supervisor Kim Lee Fields. His pockets were stuffed with more ammunition, Youngblood said.

"This teacher and this counselor stood there face-to-face not knowing if he was going to shoot them," Youngblood said. "They probably expected the worst and hoped for the best, but they gave the students a chance to escape."

Heber's forehead was grazed by a stray pellet, but Youngblood said the teacher who had graduated from the Taft school two decades ago was unaware he had been hit and didn't need medical attention.

"He's the nicest teacher I know," Nuno said. "He loves his students and he always wants to help."

Administrators closed the school Friday as residents of this remote town of 9,400 that sits amid tumbleweeds and oil fields about 120 miles northwest of Los Angeles tried to make sense of what happened.

"We know each other here," said former Mayor Dave Noerr. "We drive pickups and work hard and hunt and fish. This is a grassroots town. This is the last place you'd think something like this would happen."

The 16-year-old suspect's name is on the lips of everyone in town, but authorities aren't releasing it because he's a juvenile. He had felt bullied by the victim for more than a year, said Youngblood, who added that the claim was still being investigated.

Trish Montes described her neighbor as "a short guy" and "small" who was teased about his stature by many.

Montes said her son had worked at the school and tutored the boy last year.

"All I ever heard about him was good things from my son," Montes said. "He wasn't Mr. Popularity, but he was a smart kid. It's a shame. My kid said he was like a genius."

On Wednesday night the teen went home and plotted revenge against two students, Youngblood said. He found a gun that authorities believe belonged to the suspect's older brother and went to bed that night plotting revenge against two students.

"He planned the event," Youngblood said. "Certainly he believed that the two people he targeted had bullied him, in his mind. Whether that occurred or not, we don't know yet."

The suspect arrived after 9 a.m. Thursday, and video surveillance cameras captured him looking nervous as he entered through a side door, Youngblood said. He made his way to the second floor of the school's science building, where Heber's class with 28 students inside was under way.

The suspect walked in a door close to the front of the classroom and shot his classmate. When the shots were fired, Heber tried to get the more than two dozen students out a back door and engaged the shooter in conversation to distract him, Youngblood said.

"The heroics of these two people goes without saying. ... They could have just as easily ... tried to get out of the classroom and left students, and they didn't," the sheriff said. "They knew not to let him leave the classroom with that shotgun."

"When your son does the right thing, you have to feel fantastic," said the teacher's father, David Heber, who also lives in Taft.

He described his son as a "teacher who knows every single one of his students and not just by name."

He said his son had been teaching science to different grade levels for seven or eight years. The younger Heber was student body president when he went to Taft, his father said.

Heber couldn't remember any other time when a confrontation turned so violent. "I don't think he's ever been in a fight in his life. He can always talk himself out of it."

Youngblood said that the suspect would be charged with attempted murder. The district attorney will decide whether he's charged as an adult, Youngblood said.

Authorities said a female student was hospitalized with possible hearing damage because the shotgun was fired close to her ear, and another girl suffered minor injuries during the scramble to flee.

Wilhelmina Reum, whose daughter, Alexis Singleton, is a fourth-grader at a nearby elementary school, got word of the attack while she was about 35 miles away in Bakersfield and immediately sped back to Taft.

"I just kept thinking this can't be happening in my little town," she told The Associated Press.

Officials said there's usually an armed officer on campus, but the person wasn't there because he was snowed in.

The attack there came less than a month after a gunman massacred 20 children and six women at Sandy Hook Elementary School in Newtown, Conn., then killed himself.

That shooting prompted President Barack Obama to promise new efforts to curb gun violence. Vice President Joe Biden, who was placed in charge of the initiative, said he would deliver new policy proposals to the president by next week.

Symantec flags malicious Android porn wallpaper apps

Security giant sounds alarm over discovery of malicious data-stealing wallpaper apps.

Up to 1.5 million Android users may have suffered a serious data breach after downloading malicious apps, according to Symantec.

The security giant identified three apps, all posing as pornographic wallpapers, that were available through Google Play for more than 30 days, despite pornography being banned from the store.

Once downloaded, the app steals the user?s Googlemail address, GPS co-ordinates, handset IMEI number and network operator information.

This data is then transmitted by the app back to a remote command-and-control server.

Analysis run by Symantec showed all three apps were from the same developer and are all identified by the company as Android.Coolpaperleak.

The organisation also discovered the apps were not a modified version of a safe app, but were malicious from the beginning.

?The erotic and porn industries are the most browsed on the internet,? said Lionel Payet, a Symantec threat intelligence officer.

?If you just combine the most downloaded type of apps (wallpapers) with the erotic and porn industries, you will have in your hands the perfect chemistry for a top download application in no time.?

This new threat comes on the back of research by fellow security player Kaspersky Lab, which showed 99 per cent of mobile malware was targeted towards the Android operating system.

Two of the most prevalent malwares detected, Opfake and Fakeinst, were so-called premium SMS diallers, which send SMS messages from a user?s phone to a premium rate service without their knowledge.

Similar SMS scam apps pretending to be official London 2012 gaming apps were also found to be targeting Android users in the summer.

Kaspersky claimed the reason Android devices were popular targets was not because of how widely used the operating system is.

?The core security issue...can be traced back to the lax security of the Google Play marketplace, especially in comparison to the Apple iOS App Store,? the company said.

?Surely more of the same is in store for 2013,? it added.

University Launches Search for Vice President, Finance and ...

The University of Virginia has launched a search for a vice president, finance and administration, to succeed Yoke San Reynolds, vice president and chief financial officer, who retired in June.

The position includes responsibility over financial and administrative services of the University. U.Va. also launched a website in conjunction with the search, and has appointed a 13-person committee to evaluate candidates.

The goal is to narrow what likely will be a considerable pool of applicants to a list of finalists this spring, with the Board of Visitors reviewing a final recommendation at its May meeting.

?Finding the right person to handle one of the University?s most important jobs is a challenge, but also an opportunity,? U.Va. President Teresa A. Sullivan said. ?This work plays a key role in helping U.Va. maintain excellence in teaching and patient care. We are fortunate to have a legacy of sound financial management and a solid foundation, with triple-A bond ratings that few others can claim in higher education. Our next vice president, finance and administration, will be counted on to protect these strengths, but also to help us find new efficiencies and growth opportunities, which our times demand.?

Foundation; Colette Sheehy, vice president for management and budget; Margaret Shupnik, professor, Department of Medicine, Endocrinology and Metabolism in the School of Medicine; Johnny Vroom, president of U.Va.?s Student Council; and Jess Wenger, environmental projects manager.

The executive search firm Brill Neumann is assisting with the search. Based in Boston, the company is nationally known for its success with clients in higher education, business and health care.

The job description states that the ideal candidate will be ?an accomplished finance leader with notable executive level experience in the private, public, and/or nonprofit sectors. Ideally, he/she will have some knowledge of the academic environment, including academic medicine.??
