The amendments, which affect the Municipal Act and City of Toronto Act, have to do with a financing tool used by municipalities called ?local improvement charges.?
If a sewer pipe is replaced, a sidewalk laid or a road repaved a town or city can spread part of the cost among affected property owners through a special charge added to their property tax bill.
To date, such charges have been limited by law to neighbourhood improvement projects. But Toronto councillor Mike Layton said the proposed changes would allow municipalities to enter into agreements with individual property owners wishing to, for example, invest in changes to their home that would reduce energy or water consumption.
?Your property itself can qualify for a local improvement charge,? said Layton, who is eager to see pilot projects launched in Toronto that would take advantage of this new municipal tool. ?We?ve got to prove to people that this works.?
It?s an important development, given that the McGuinty government seems to have dropped the ball on its conservation efforts. As Gord Miller, Ontario?s environmental commissioner, recently pointed out in an annual report, ?the conservation promises of the Green Energy Act remain unfulfilled? and ?some commitments appear to have been quietly abandoned.?
Empowering municipalities may be one of the best ways to make up for lost time. The regulatory changes mean municipalities would be able to leverage their ability to raise cheap capital through bond issues, and then offer homeowners low-interest financing that can be paid back over 10 or 15 years through property taxes.
If designed correctly, the energy or water savings that result will more than offset the monthly or annual payments. In the case of solar, revenues from clean electricity sold to the province under the feed-in-tariff program would more than cover the local improvement charge.
An added bonus is that the local improvement charge is tied to the home, not the homeowner, so it doesn?t add to your personal debt load.
One of the key champions of this model has been Sonja Persram, president of Sustainable Alternatives Consulting Inc. in Toronto (I wrote about her efforts last November).
Persram has studied the approach closely over the past three years, working with groups such as the David Suzuki Foundation to build support among business leaders, labour groups and particularly Ontario municipalities.
?There?s been a huge amount of interest from a broad spectrum of municipalities, at all levels,? said Persram, adding that she?s pleased to see the province taking action.
Another big fan is Bill Johnston, former president of the Toronto Real Estate Board and current director with the Canadian Real Estate Association.
?The program imposes no costs upon any level of government. In fact, it may provide a small return at the municipal level,? he said. ?It will create employment, generating extra tax dollars at the provincial and federal levels. Furthermore, by improving indoor air quality, health care costs will be reduced.?
Layton, anticipating that the amendments will be passed, sent a letter earlier this month to the city?s Economic Development Committee asking that it get the city manager to develop a pilot program and conduct an economic analysis in time for the committee?s October meeting.
He envisions the program being tested in four Toronto districts, starting with a focus on energy efficiency retrofits and potentially expanding to water conservation and green energy projects, including solar and geothermal.
?We?d basically pick a handful of communities where there?s interest, and give it a try,? said Layton.
The challenge between now and then is to demonstrate to the rest of council that such a program wouldn?t come at a cost to the city. The benefits, however, are that it would contribute to environmental objectives and create economic activity and jobs for the city and surrounding region.
Another plus is that, by spurring energy and water conservation, pressure it taken off of city infrastructure. In other words, more efficient use of existing infrastructure will defer the big cost of future upgrades and expansions.
?Once you present all the evidence, and maybe I?m na?ve here, but I would think the majority of members of the executive committee would say it?s foolish to not approve this kind of strategy,? Layton said.
This all assumes, of course, that the province follows through.

The Hawks have agreed to deal All-Star guard Joe Johnson to the Brooklyn Nets for five players and a draft pick, and Atlanta will send forward Marvin Williams to the Utah Jazz for guard Devin Harris.
A person familiar with the Hawks-Nets deal told The Associated Press on Monday night that Atlanta will receive guards Anthony Morrow, Jordan Farmar and DeShawn Stevenson and forwards Jordan Williams and Johan Petro, along with a draft pick Brooklyn received from Houston in a prior deal. The selection only belongs to the Nets if it is not a lottery pick.
The person confirmed the trade on condition of anonymity because it cannot become official until Stevenson signs as a free agent with Brooklyn. Free agents cannot be signed until July 11.
Johnson has four years and $90 million left on his contract and new general manager Danny Ferry decided it was time to shed payroll and rebuild.
The 31-year-old Johnson averaged 18.8 points per game last season, his 11th in the NBA and seventh with Atlanta.
The Nets are hoping to team Johnson with free agent point guard Deron Williams, whom they are working to re-sign, in the franchise's first season in New York City after decades in New Jersey.
Utah CEO Greg Miller acknowledged the deal for former first-round pick Marvin Williams while picking up guard Mo Williams at Salt Lake City International Airport in preparation for Tuesday's introductory news conference.
The Jazz acquired Mo Williams in a multi-team deal last week that also sent Lamar Odom to the Clippers.
Miller said it was difficult to part with Harris but he was excited by what Mo Williams brings to the team.
Mo Williams said it felt good to be back where he started his career in 2003 and he had always hoped to start for his first team.
The Harris-Marvin Williams deal now clears the way for that to happen.
"It's always unfortunate when we have to let a player go because all of our players work so hard and they're so invested in helping us win." Miller said. "And it's got to be a tough thing for them. I know it is for us. I wish Devin the best in his career."
Mo Williams, dressed in a red T-shirt, black shorts and a New Orleans Saints cap, arrived in Salt Lake City about 8:30 p.m. MDT.
He only has one year left on his current deal but expressed hope that he could be in Utah long term.
"I'm very excited about a new start for me and a second homecoming," Williams said Monday night.
Jazz general manager Kevin O'Connor has called letting Mo Williams leave after just one season "the worst: mistake of his career.
"I know he says that a lot, but at the same time I was a young basketball player at the time," Mo Williams said. "Obviously he made a decision he thought was best for the organization. I never had a bad taste in my mouth about the organization. I always respected them because they gave me a shot.
"I watched 30 teams pass me in the first round. I always had a part of my heart for the Jazz and I'm glad I'm able to come back and prove my worth to them."
Harris arrived in Utah in 2011 as part of a blockbuster deal that sent Deron Williams to New Jersey.
But Harris struggled to find his niche with the Jazz, and while he stepped up his game late last season, he still has a career 31.5 percent shooting percentage from beyond the arc.
Harris, 29, is scheduled to make $8.5 million in 2012-13, the final year of his current contract.
Marvin Williams, 29, has averaged 11.5 points for Atlanta in his seven-year career, including 10.2 and 5.2 rebounds last season.
Mo Williams was an All-Star as recently as 2009, and was part of a Cleveland team that won 66 games with LeBron James and advanced to the Eastern Conference Finals in 2009. He joined the Los Angeles Clippers in 2011.
"I think it's going to be great for us to have Mo here," Miller said. "Obviously he competed at the highest level. He knows what it takes to win. . I think he's going to help us win games."
Asked if there were more moves to come for the small-market Jazz, Miller said, "I hope so."

SERAING, Belgium (AP) ? Peter Sagan blushed, giggled and eventually brushed off comparisons to Lance Armstrong on Sunday after becoming the youngest rider to win a Tour de France stage since the Texan nearly a generation ago.
The 22-year-old Slovak gave a command performance in his debut in a full Tour stage by outsprinting Swiss rider Fabian Cancellara, who mounted a spirited and successful defense of his yellow jersey over a hilly ride in eastern Belgium in Stage 1.
The standings among the top contenders to win the three-week race didn't change much after the 123-mile loop from Liege to suburban Seraing featuring five low-grade climbs. Bradley Wiggins of Britain and defending champion Cadel Evans trailed close behind in a splintered pack.
Overall, Wiggins is second behind Cancellara, seven seconds back, and Evans is another 10 seconds slower in eighth.
Sagan, who won five of eight stages in this year's Tour of California among the 13 stage victories he has this year, placed his hands on his shoulders after edging out Cancellara and Norway's Edvald Boasson Hagen. It was the culmination of a tricky uphill patch with cobblestones right before the finish.
The promising Slovak becomes the youngest rider to capture a Tour stage since Armstrong won his first of his 22 career Tour stage victories at age 21 ? in Stage 8 in 1993. The youngest of all time is Italy's Fabio Battesini, who was 19 when he won one in the 1931 Tour.
Sagan landed another spot in the history books: No other Tour debutant has won the first Tour road stage since Fabio Baldato of Italy 17 years ago, according to Infostrada, a Dutch sports information service. David Zabriskie of the United States won the opening time-trial in his first Tour in 2005, but that wasn't a full road stage.
Asked whether he has the potential to be the next Armstrong, Sagan cautioned that such talk was a bit premature: "I would like to be, but I'm so young it's impossible to know what the future will be."
"If that could be true, it would be great," the Liquigas-Cannondale rider said with a nervous laugh.
He rose to 23th place overall, 24 seconds behind Cancellara, after entering the day in 56th place ? 3:49 behind ? after the prologue that Sagan said wasn't suited to his talents.
To have a chance to achieve Armstrong's stature, Sagan will have to prove that he's a complete rider who can excel in time-trials and the mountains ? not just a "puncher" who can burst ahead late on flatter stages.
He'll get that chance in two time-trials ahead and as the race veers to the Alps in Week 2 and down into the Pyrenees mountains before the July 22 finish on Paris' Champs-Elysees.
Cancellara, the 31-year-old veteran who won Saturday's prologue, offered racing panache with an aggressive final attack ? an unusual move because the bearer of the yellow jersey generally spends more effort trying to defend it than going on the offensive himself.
"We got absolutely no help from other teams, so I said the best defense is to attack," he said, referring to his RadioShack squad. "I saw the last turn with a little stretch of cobbles and I said, 'Here, full gas.'"
"I'm not the kind of rider that gives up with 500 meters left," said the Swiss veteran. "That's not me. If I try something I go all the way ? and if I finish second, that's just how it goes."
Sagan hugged the wheel of Cancellara, who was doing the hard work of leading into the wind, then whipped around him with less than 150 yards left to win in 4 hours, 58 minutes, 19 seconds.
At least two crashes marred Sunday's stage amid escalating tensions within the pack near the finish, where roadside crowds drew in to get a glimpse of the whirring bicycles.
High-profile riders including Spain's Luis Leon Sanchez and Michael Rogers of Australia went down in one late spill, but got back up. Bad luck continued to plague Germany's Tony Martin, who went down in a crash early Sunday before recovering. The world time-trial champion popped a flat and lost time in the prologue the day before.
At one point, with his team leader Evans riding in his wake, Marcus Burghardt of Germany caused his bike to jump to avoid a plastic bottle in a downhill patch about 10 miles before the finish.
"The first stages of the Tour: Everyone's so keen to get going, and everyone's so nervous," Evans said.
Monday's second stage takes the pack on a mostly flat 129-mile jaunt slicing west across Belgium from Vise to Tournai, which could favor a sprint finish.

In Vilma?s new lawsuit against the NFL, a copy of which PFT has obtained, lawyer Peter Ginsberg details every alleged flaw in the case against Vilma, and to a certain extent the other players suspended for involvement in the Saints bounty program.
Heavy on factual contentions and light on legal theories, the lawsuit requests only two things:? (1) an order of ?specific performance? requiring Goodell to rule on the bounty appeals; and (2) a temporary restraining order and preliminary injunction preventing the league from implementing the suspension against Vilma if the suspension is upheld.
Along the way, Ginsberg makes the following claims on behalf of Vilma:
1.? Vilma was willing to meet with Goodell before the one-year suspension was imposed, but Vilma wanted to review in advance the materials gathered by the league ??which the NFL contend[ed] provided a basis to investigate Vilma.??? In exchange, ?Vilma offered to provide the NFL with complete ?detail[] [of] Vilma?s knowledge regarding [the Bounty Program] allegations.?? The league declined to do so, so Vilma declined to meet with Goodell.
2.? Goodell issued a ?gag order? on former Saints defensive coordinator Gregg Williams, preventing him from speaking to about about the investigation.
3.? Goodell made ?personal conclusions and described possible discipline? of players in a March 21 press release, even though he had not disciplined any players and planned to eventually serve as the supposedly impartial arbitrator.
Ginsberg also outlines the alleged flaws in the investigation, focusing on the follwing:
1.? The refusal to make certain witnesses available at the June 18 appeal hearing;
2.? The failure to deliver the exhibits to be introduced at the June 18 appeal hearing within three days (i.e., 72 hours) of the start of the hearing;
3.? The production of only 16 exhibits consisting of 182 pages from a file that supposedly includes 18,000 total documents and 50,000 total pages;
4.? The failure to produce any notes taken during witness interviews;
5.? The failure to produce original documents;
6.? The refusal to produce any potentially exculpatory evidence;
7.? The reliance on documents generated after the discipline were imposed;
8.? The alleged mischaracterization of the Anthony Hargrove declaration;
9.? The alleged mischaracterization of the Anthony Hargrove video from the 2009 NFC title game;
10.? The alleged mischaracterization of the September 2011 Mike Ornstein email message regarding an alleged $5,000 bounty on Packers quarterback Aaron Rodgers;
11.? The failure to include the September 2011 Mike Ornstein email message in the evidence to be introduced at the appeal hearing;
12.? The alleged mischaracterization of the 2009 email message from Ornstein to Williams, which Vilma claims reflects a commitment by Ornstein to contribute money to Williams? charitable organization (Ornstein allegedly explained this to Goodell, urging him to confirm it via the charity?s financial documents);
13.? Ornstein?s contradiction of the claim that he corroborated the allegation that Vilma placed a $10,000 bounty on Brett Favre prior to the 2009 NFC title game;
14.? The failure to make Ornstein available to testify at the June 18 appeal hearing or to produce notes of his interview(s);
15.? The strong denial by Saints interim coach Joe Vitt that Vilma placed a bounty on Favre or anyone else;
16.? The failure of the league to disclose that Williams never acknowledged to the NFL the existence of a bounty program;
17.? The alleged problems with the ledger information apparently leaked to Jason Cole of Yahoo! Sports on June 1, 2012, and the failure of the league to introduce the ledger as evidence at the June 18 appeal hearing;
18.? The reliance upon the statements of Mike Cerullo, a disgruntled former Saints employee;
19.? The problems with the typewritten version of handwritten notes regarding the bounty on Vikings quarterback Brett Favre, which Vilma contends were created ?well after? the 2009 NFC title game;
20.? The failure to issue a ruling on the appeal by Monday June 25, 2012, one full week after appeal hearings at which Vilma offered no substantive defense.
It?s unknown whether Vilma will get a chance to prove all of these allegations, and whether his ability to do so will result in his suspension being overturned.? It?s clear, however, that ?Phase Two? has begun ? and that it could last a lot longer than Phase One.

Some politicians and law enforcers during the political turbulence of 2011 thought so but recent research suggests that uncensored citizens experience less violence and longer periods of peace between outbursts than communities subject to censorship. These new findings appear in the Bulletin of Sociological Methodology, published by SAGE.
A consensus is forming around Internet censorship in the wake of last year's uprisings, extending from the Arab Spring to the UK, according to Antonio Casilli, associate professor in digital humanities at Telecom ParisTech, France and Paola Tubaro, senior lecturer in economic sociology at the University of Greenwich, UK. The authors used sophisticated computer modeling to find out if the assumptions that actors' use of media such as Twitter fueled mob action through greater awareness were true. Ambiguously, current narratives among the European political establishment suggest social media can be either the tools of liberation (in developing countries) or threats to values of peace and freedom (in Western countries).
The researchers used state-of-the-art agent-based modelling as a starting point. Political conflict is often described as cumulative, involving 'escalating' conflict and sometimes ending with regime change. However, in reality, periods of relative stability punctuated with violent outbursts are more typical. Existing models include a variable called 'vision,' an individual agent's ability to scan his/her neighbourhood for signs of police officers and/or active protesters. Higher vision means greater awareness of one's surroundings and a larger range of possible actions.
In Casilli and Tubaro's computer simulation, censorship narrows down vision. It interrupts the flow of communication and decreases the ability of individuals to appreciate their environment. In this sense, censorship blinds social actors to their own context.
The researchers found that all possible scenarios led to initial outbursts of violence but how the situation evolved was significantly influenced by government social media censorship. In a total censorship scenario, similar to the Egyptian riots, violence levels remained at a maximum. Stronger censorship led to an increase in the average level of endemic violence over time.
According to the model, the "no censorship" situation at first appears bleak, with incessant, high-level violent outbursts that seem larger than in other scenarios. However, looking at average violence levels over time, the uncensored scenario still has the least aggression. Although agents protest, sometimes violently, they are able to return to relative calm for longer periods in-between. The decision to maintain peace is the choice of agents themselves, rather than due to police repression.
This research offers an interesting methodological bridge that shows how rules operating at the micro or individual level can account for collective dynamics. This is particularly interesting at a time when research is trending into two camps, either using micro-motives (such as personality, culture, and morals) or macro-indicators (such as poverty and social stratification) as explanatory factors.
"In the absence of robust indicators as to the rebelliousness of a given society, the choice of not restricting social communication turns out to be a judicious one for avoiding the surrender of democratic values and freedom of expression for an illusory sense of security," say Casilli and Tubaro.
